LAND LAWS ON LIMITATION OF ACTION CAP 22 SEC 7

Claims on recovery of land should be made before 12 years of a deed.
This therefore means no claims should be made on a property after 12 years have lapsed.
Other claims eg partition, measurements, pathways or boundaries must be made with 6years .

For the following reasons:

● Neglecting or abandoning or just not utilizing the land.
●leaving your land to people to whom terms of custody are not clear.
●Allowing people to occupy your land without permission neither contestation(dispute).
● Ignorance of the land laws of Kenya on limitation of action act cap 22 sec 7,13,17 and even 38 ●Trying traditional ways of eviction e.g
giving demand letters or sending wazees etc


What you can do to avoid this:

■ Ensure formal entry e.g let the terms be clear.
If they are employees, keep records of salaries paid. Always avoid paying with gifts etc.If you leased or rented it out, have payments reports for the same
■Keep records of your personal involvement in the property this can be in videos , pictures which correctly depicts the property/ land with identifiable futures well captured.
■Fence and protect borders of the land
■ Report and properly follow up on any encroachment. Procrastinating on such follow up and processes has costed many of their hard earned properties.

Don't run to the courts when it is too late.
The lawyers may eat your cash knowing we'll that the case has no remedy.
