A Mutation Form is an official land survey document used to subdivide, amalgamate, or change the shape of a registered land parcel.

In simple words, it’s the legal form that records changes in the boundaries or size of land.

πŸ‘‰ Why is it called β€œMutation”?
In land surveying, the word β€œmutation” means change.
So, a Mutation Form records a change from the original parcel to new parcels.

βœ… WHEN IS A MUTATION FORM USED?
1️⃣ Subdivision:

When you split one big parcel into smaller plots.
➑️ E.g., splitting 1 acre into 8 plots of 50x100 ft.

2️⃣ Amalgamation:
When you merge two or more parcels into one.

3️⃣ Boundary Adjustment:

Legal Tips for Buying Land/Properties in Kenya

1. Family Properties:
- Ensure you deal with the Head of the family and at least two principal adult members.(The nominated Admin)
- The sale is invalid if only the Head or only the principal members sell the property.
- Avoid dealing with just one person claiming to represent the family without verification.

2. Buying from a Company:
- Obtain the Status Report of the company before any payment.
- Confirm the property is registered in the company’s name and ensure the directors sign the documents.
- Insist on the seller’s identification and, if selling on behalf of a family, request the Deed of Power of Attorney.

3. Title Verification:
- A Certificate of Occupancy (C of O) alone is not conclusive proof of title.
- Verify the C of O’s authenticity and ensure the property is unencumbered.
- For properties with a Deed of Assignment, ensure it is registered, stamped, and verified as unencumbered.

4. Properties from Religious Organizations:
- Ensure the property is registered in the official name of the Church or Mosque.
- Deal with registered Trustees, not just any Imam or Pastor.

5. Buying from a Couple:
- Request their marriage certificate and deal with both spouses.(Or a spousal consent)
- Ensure both husband and wife sign the documents in the presence of a witness.

6. Properties under a Will:
- Verify the will and ensure it is not under litigation.
- Confirm the Executors have issued an Assent to the beneficiary selling the property.
- Obtain a copy of the Probate issued to the Executors or Letters of Administration.

7. Buying from a Developer:
- Title documents alone are insufficient.
- Ask for development or building permits and evidence of payment of ground rents and land use charges.

Before you confuse this message...kindly note that we are not land brokers.

We are surveyors and land consultants, and our job is to help those buying land to get a genuine deal.

It's no a secret that many Kenyans are losing their hard earned money everyday on fraudulent land deals.

There is an impending legal battle here simply because someone decided to ignore the 5-4-3-2-1 Excavation rule. Before you ask me what that means.

Here I go, when you are excavating anywhere 5 meters below the ground, your trench walls should slope back 4 meters. For 4 meters deep, you slope back 3 meters upto 1 m.

In all these, there is an elaborate attempt to maintain the structural integrity of the surrounding structures while also controlling the extent of both soil disturbance and distress in equal measure. Otherwise, those perimeter walls and by the extension the surrounding structures will slowly but surely start feeling settlement effects.

Steps to Replace a Lost or Destroyed Title Deed:

1). The owner conducts an official search

2). The owner acquires police abstract

3). The owner fills the application for a replacement certificate of title of a previous title form

β€’ Police abstract
β€’ Certified copy of ID
β€’ Colored passport-size photo
β€’ Search results document and any other document evidencing ownership

4). Fill the statutory declaration form, which acts as an affidavit declaration of loss

5). Submit all to the land registrar

6). Registrar issues notice of intent to replace title using the form

7). Notice is gazetted at the Kenya Gazette and in 2 local dailies, giving 60 days grace period

8). If not contested, the registrar issues a new title deed if satisfied with the evidence submitted.

PROCEDURE OF PURCHASING LAND IN KENYA

If you are buying land from an individual or group please follow the following STEPS to avoid being CONNED:

1 . Ask to see the TITLE DEED or Copy of the title deed. Then do a search at the ministry of lands to confirm who the real owners are or if the title has any CAVEAT on it, The search will cost you Sh 520.

2.Do a search with LOCAL AUTHORITIES to check of any unpaid land rates. If any, agree with the seller who will settle the land rates. NB :LAND can't be transferred if they are unpaid land rates.

3.Go to the ministry of lands and buy 2 Maps, one showing the exact measurements of the piece you are buying called (mutation) and the other showing the neighbouring lands, Each costs Sh 350.

4.With your 2 maps and a registered or licensed surveyor, visit the land you are buying and verify the details on the MAP. Check out all the beacons.

5.Sit down with your seller and bargain the price. Write down an agreement. The agreement can be done in the presence of a lawyer. According to LSK if the value of the land is below 1 million you pay the lawyer 3K, if it's above 1 million you pay the lawyer 8K for the agreement.

6.Pay some amount as per your agreement, Don't pay everything Hata k**a pesa uko nayo.

7.Book a meeting with lands control board (LCB) They meet once every month. It will cost you Sh 1570.
LCB will issue consent for the land to be sold.

8.pay the remaining balance after getting consent from LCB.

9.Go to ministry of lands offices with your KRA PIN, 2 passport photos and a copy of the TITLE DEED to change ownership.
It will cost you Sh 5000.

10.At this stage you don't need the seller. Now go pay stamp duty, ie according to the VALUE of the land.
4% of sales value in municipalities &
2%of sales value in reserves.

11.Now the land belongs to you, but before celebrating go to the ministry of lands &do a search to confirm if they have updated their RECORDS and it reads you.
