DON’T BE A VICTIM OF FRAUDULENT LAND TRANSACTIONS
The process of buying land in Kenya may look simple for a newbie, which is not the case. Land is a real asset, anyone planning to own one, must follow the legal process so as to avoid issues later after paying for the same.
Below is the process to follow before you are declared the authentic owner of land in Kenya.
1.Ask to see a title deed or a copy of title deed.
2.Do a search with the local authorities pale ministry of land ( Ardhi house). Confirm the real ownership, any unpaid land rates or if the title deed has any caveat on it. NB: Land can't be transferred with unpaid land rates or with a caveat .
3.Go to the ministry of land buy a map and a copy of mutation.
4.With the map and a copy of the mutation find a professional surveyor at Dig-land solutions, visit the land you are buying and verify the details on the map. Check out all the beacons.
5.Bargain the price with the seller and write an agreement before a lawyer or you may do it yourself with a witness. The spouse MUST BE present!
6.Pay some amount or as per your agreement. Usilipe pesa yote Jomba.
7.Book a meeting with land control board ( LCB).They normally meet once in a month or you can book a special LCB meeting . LCB will issue with consent for sub-division or transfer.
8.Pay the remaining balance after getting consent from LCB
9.With the consent from LCB, recent search, clearance form from county land rates, KRA pin (both for seller and buyer), 2 passport photos and a copy of title deed, go to the ministry of lands and change ownership.
10.Lastly go and pay stamp duty i.e 4% of the Land value within municipalities and 2% of the Land value in reserves.
Now you legally own the land.
