CONVERSION OF TITLES BY THE MINISTRY OF LANDS
The Ministry of Lands and Physical Planning is proceeding to convert titles that were originally under the repealed Government Lands Act, the Registration of Titles Act, the Land Titles Act and the Registered Land Act to the new regime under the Land Registration Act (2012) and the Land Registration (Registration Units) Order, 2017. This basically means that all the land regimes will be consolidated under the Land Registration Act that was enacted in 2012.
The conversion will however not affect your ownership, the size of the land and any other interests registered against the title.
If your land was registered under the old regime, it would be important to look out for gazette notices of the cadastral maps. In the event that you have a complaint in relation to the conversion, you will need to file it at the Lands Office within ninety (90) days.
It will be interesting to also see how Section 13 of the Sectional Properties Act will apply to leases, especially those that were issued under the repealed RTA. The typical long-term leases over apartments and commercial units will be faced out with time.
We hope that the Lands Offices will not be a mess with all the conversion that will be undertaken over the titles in the old regime, but after the transition period, this will definitely make the land registration processes much easier and straight-forward.
