Rental Agreement

There must be a rental agreement for properties which states out rights and obligations for each party and lists out consequences. In the case of a co-tenancy or multiple dwellings, the agreement may also set out the relationship between co-tenants. These may also be stated in By-Laws issued by the Management Company. Parties to the agreement must read it - including any footnotes and fine print before appending their signatures.

The new tax bill requires landlords to file their tenants' details on the KRA i-tax platform. The details include names, addresses, post code & rental amount. The PIN is currently optional. Landlords are expected to carry out minimal due diligence on their tenants. The easiest way is to have this information at the signing of the lease agreement. A good agent should be able to KYC a tenant they refer to the landlord and provide adequate references that the tenant is who they say they are.

A lease agreement determines the relationship between lessor & lessee. It lists out the rights & obligations of both parties.

Recently a tenant who wanted to vacate without notice, without paying rent & without putting the appartment back to its original condition had the audacity to bring cops to the court.

We showed the cops the lease agreement and only requested that tenant fulfils her obligations under the lease. The tenants 'case' collapsed much to their chagrin. The tenant paid the rent as the cops stood by & promised to have house fixed before vacating.

Being a landlord is no easy walk in the park but what upset me is the tenant calling them self a "woman of God".
