💡 Who Owns an Idea? Protecting Innovation in Kenya

From fintech to creative industries, innovation is the lifeblood of Kenya’s economy. But behind every great idea lies a critical question: how do you protect it?

This is where Intellectual Property (IP) and Innovation Law steps in. It governs the rights of creators and innovators, covering:

🔹 Copyright – protecting artistic, literary, and technological works.
🔹 Patents – securing new inventions and processes.
🔹 Trademarks – safeguarding business identity and brand.
🔹 Industrial designs & trade secrets – protecting unique product designs and confidential know-how.

For entrepreneurs, startups, and creators, understanding this area of law isn’t optional it’s essential. Proper registration and legal safeguards ensure that your innovation works for you and not against you.

At Mundui Murai Advocates, we help innovators navigate this complex legal space from registration to enforcement so their ideas remain protected, respected, and profitable.

Do I need a Trust for my children?

A Family Trust provides continuity of the estate /property of the grantor by ensuring that the estate/property devolves to future generations and more importantly through capable and reliable people/trustee. It protects the beneficiaries in the event of bankruptcy, divorce or death.
Your children may not be able to manage your estate in the event of crisis under the age of 18, but a trust fund ensures that their physical needs like Education, Health care, Accommodation amongst others are taken care of despite such occurrences.

Benefits include the following:
1. Asset Protection and Management: A trust allows you to specify how and when your children will receive their inheritance, which can be beneficial if they are minors or you have concerns about their ability to manage money responsibly.

2. Avoiding Probate: Assets placed in a trust can bypass the probate process, leading to a quicker and more private transfer of assets to your children.

3. Tax Considerations: Depending on your estate's size, a trust may offer tax advantages, such as reducing estate taxes or protecting assets from creditors.

4. Special Needs: If you have a child with special needs, a special needs trust can ensure they receive their inheritance without jeopardizing their eligibility for government benefits.

5. Blended Families and Specific Wishes: If you have children from different relationships or specific wishes for how your assets should be distributed, a trust can ensure these wishes are followed.
