As of 1 August 2026, real estate agent fees in Mauritius are set by regulation rather than market convention. Under the Real Estate Agent Authority Act 2020, brought into force by Proclamation No. 14 of 2026, the maximum fee an agent may charge is now prescribed by law.

The ceilings are as follows:

Sale or purchase of immovable property: 2% of the value of the transaction, payable by the buyer, and 2% payable by the seller.
Rental of immovable property, short-term or long-term: 8% payable by the landlord, and 8% payable by the tenant.

The value of the transaction is defined as the total consideration under the deed of sale for a purchase, the total rent payable for a short-term rental, and twelve months of rent for a long-term rental. VAT at 15% applies in addition, as every registered agent must account for VAT irrespective of turnover.

Two points matter for clients. First, these are maximum figures and remain negotiable downwards. Second, every agent, land promoter and property developer transacting in Mauritius must now hold a registration certificate from the Real Estate Agent Authority, with the transitional window closing on 31 October 2026. An unregistered operator has no legal right to collect a commission.

For ÕME, this changes very little in practice. Our fees have always been stated in writing before any mandate is signed, and five per cent of every commission we earn is committed to verified housing projects. Regulation now requires of the whole market what we have held ourselves to from the start.
