Most sellers don’t realize how much they can legally reduce—or even eliminate—capital gains… until it’s too late.

A few key things that make all the difference:

• Get your RFC set up early (not last minute)
• Your property needs to be your actual primary residence
• Residency status can strengthen your position
• Keep every factura—no receipts, no deductions
• Timing matters (exemption rules apply)
• And most importantly… plan before you go to market

Buying property in Los Cabos often comes with a lot of questions — especially for international buyers. So here are a few of the most common things people ask me.

Is it a buyer’s or seller’s market right now?

Currently, it’s a buyer’s market. Inventory is up and properties are sitting longer, which means buyers have more room to negotiate than they’ve had in years.

Is Los Cabos safe? Should I cancel my travel plans?

Los Cabos continues to be one of the safest areas in Mexico for expats and visitors. Baja California Sur maintains a Level 2 advisory (exercise increased caution) — the same level given to countries like France and Italy.

As a foreigner, do you actually own property in Mexico?

Yes. Most buyers use a bank trust (fideicomiso) where the bank acts only as a custodian. You still have 100% rights to sell, rent, or pass the property on to your heirs. The trust is issued for 50 years and is renewable indefinitely.

Another option? A Mexican corporation.

Some buyers choose to form a 100% foreign-owned Mexican company, which allows direct fee-simple ownership without a bank trust. This structure is often used for investment properties or rental portfolios, though it does require ongoing accounting and tax filings.
