这宗RM500,000 假地主租地案，令我吃了一惊！

原因是类似的案件,家人曾经遇过，但是家人觉得有问题，所以没有deal 成！

看了很多买地被骗案，没想到“租地”也会被骗！

整件事怎样发生？

2025年10月，这名44岁的公司董事接触到一名人士。

对方向他表示，自己是代表一家公司的，而该公司拥有一幅土地，可以出租给他进行油棕种植。

双方谈妥后，受害者同意租下有关土地。

这里有一个很值得注意的地方：

RM500,000并不是一次过付款。

根据警区主任的说法，受害者从：

30 October 2025 → 4 November 2025

分阶段进行数次付款，最终一共支付：

RM500,000

作为土地租赁的 deposit / rental payment。

钱付完以后，他才发现一个致命问题：

这幅土地从来没有登记在对方所代表的公司名下。

也就是说，对方声称：

「这块地是我们公司的。」

但受害者付款之后去查，发现：

Land Registry 的 registered owner 并不是这家公司。

他发现自己可能受骗后，于 2026年2月13日 报警。

那要怎样避免这种事情发生？

其实不管你是租 Factory，还是租 Industrial Land，

对方给你看 SSM、给你公司资料，甚至 Agreement 都准备好了，

都不代表他一定有权出租这个 Property。

尤其涉及几十万 Deposit，更加不要急着付款。

我会建议老板在付款之前，先做好这几件事：

第一，做最新的 Land Search。
确认现在的 Registered Proprietor 到底是谁。

第二，如果地主是一家公司，确认谁有权代表公司签。

公司名字对了，不代表任何一个 Director、Shareholder 或员工都可以代表公司处理这项 Property。

让律师确认签约主体，以及签署人是否有相应的 Authority。

第三，如果跟你谈的人不是 Registered Owner，先问清楚：

“你凭什么代表地主？”

Agent、Representative、Master Tenant 或其他第三方，身份都不一样。

重点不是他说自己是谁，

而是有没有相应的文件和授权证明。

第四，大额 Deposit，不要随便直接付给对方。

其实为什么正规的 Real Estate Transaction，会有 Stakeholder 这样的安排？

就是因为在交易还没有完成、一些条件还没有确认之前，

这笔钱是不会随便被 Release的‼️

尤其租 Factory、Industrial Land，

Deposit 可能不是 RM5,000、RM10,000，

而是几十万。

所以付款之前一定要搞清楚：

钱付给谁？
谁以 Stakeholder 身份保管？
什么条件达到以后，钱才可以 Release？

Stakeholder 的作用，就是按照相关协议或约定的条件暂时持有款项，而不是收到钱就马上交给其中一方。

这也就是为什么一个正规的 Industrial Property Transaction，

Payment Flow 本身，就是交易安全很重要的一部分。

当然，Stakeholder 的存在不代表你可以省略前面的 Due Diligence。

Land Search 要查。
Registered Owner 要对。
Authority 要确认。
Agreement 要看清楚。
Payment Release Condition 也要清楚。

专业的 Agent、Agency、Lawyer，不只是负责把 Deal 做成。

更重要的是，

每一个人在正确的位置，把交易流程做好。
