IN MALAYSIA, the Board of Valuers, Appraisers, Estate Agents and Property Managers is established under the purview of the Ministry of Finance to professionally regulate the Real Estate Industry professionals.
They are categorized into three levels of certification, for the ease of identification of their respective prescribed authority of practices. Some are regulated while others are certified. Letโs look at what are the respective levels of authority of practices.
Real Estate Agents (REA)
Probationary Estate Agents (PEA)
Real Estate Negotiators (REN)
Real Estate Agents (REA) and Probationary Estate Agents (PEA) are REGULATED by the Board, and Real Estate Negotiators (REN) are CERTIFIED by the Board.
The general public needs to be aware and educated that the above are THE ONLY professionals regulated and certified by the Board who are permitted to transact official real estate matters in Malaysia.
Any other individuals other than the above are prohibited from transacting any real estate matters with the general public except the followings in accordance with Section 22C of the Valuers, Appraisers, Estate Agents and Property Managers Act 1981 (Act 242):
a) an owner of any land, building and any interest therein may sell or rent or lease or sub-lease, or offer to sell or rent or lease or sub-lease;
b) a licensed auctioneer may sell or offer to sell any land, building and any interest therein by public auction;
c) a holder of a power of attorney in respect of any land, building and any interest therein, acting gratuitously and for no commission, fee, reward or other consideration;
d) a Negotiator may assist the registered estate agent in the estate agency practice.
This is to ensure that the public at large and stakeholders are protected against malpractices, fraud and misrepresentation. To verify an agent authentication identity, the public can visit www.lppeh.gov.my to verify the authenticity and legality of an agent or negotiator.
At the entry level, an individual begins his or her journey into the practice of real estate agency by first attending the Negotiatorโs Certification Course (NCC), from the approved institution accredited by the Board. Thereafter, he or she will be required to attach to a registered real estate firm registered with the Board of Valuers, Appraisers, Estate Agents and Property Managers in which he/she will be called as โReal Estate Negotiatorโ or REN.
If a REN wishes to pursue further in the career, he/she can proceed to be registered as Probationary Estate Agent (PEA), once the required board examinations or academic qualification is met. Upon approval, a PEA will be given the authority to practice by the Board as a Real Estate Agent or REA which will possess authority to supervise 50 RENs or PEA under an REA. A Real Estate Agent is also known as the license holder or the principal of a Real Estate Agency firm.
Annually, all RENs are required on a mandatory basis to attend a Continuous Development Program (CDP) to renew their REN tag for the following year. As for PEA & REA, they are required to attend Continuous Professional Development (CPD) yearly to renew their authority to practice after the required number of hours are fulfilled.
The above strict compliance must be adhered to continue their practice as a Real Estate professional in Malaysia. The Board ensures that all who come into handling Real Estate transactions with the general public must be knowledgeable, proficient, and professional in their dealings, to safeguard the best interests of the public, clients, and all stakeholders.
