请问母子之间的商铺转让需要缴交 RPGT 和 Stamp Duty 吗?

答:
1.根据最新的2023年财政预算案,父母和孩子、祖父母与孙子女之间的房产转名,将可豁免印花税。如果房产价值在100万令吉或以下,转名的印花税将全免;而超过100万令吉的部分,则需根据从价税率计算,而其中可享有50%的印花税豁免。
2.该优惠适用于2023年4月1日或之后签署的房地产转让文件。受益人必须是马来西亚公民。
3. 至于RPGT,如果你是一名大马公民,并且你是通过亲人之间赠与(kasih sayang)的方式,把房地产割名给你的配偶、父母、子女、祖父母或者孙子女,那么就可以享有RPGT豁免优惠。
4. 不过假如你在继承了有关房产后就想立刻出售,你会被征收RPGT。除非你在出售房地产时并没有收获任何利润(原价卖掉),或者你在出售房地产时面临亏损(亏本卖掉),那么你就不必缴纳RPGT。
5. 产业盈利税RPGT的计算方法如下,首先,你要把可征税所得(也就是卖房的盈利:脱售价和当初买价算出的差价)。然后,你再将可征税所得乘以相关的RPGT税率,就能得出你必须支付的产业盈利税了.
6. 一般上建议在五年后脱售你的房产,而不是在短时间内炒房。产业持有期越短转售,RPGT 税率越高。
