💡7 Things a foreign investor should know about Australian property investment

1️⃣ Foreign Investment Review Board (FIRB) Approval:
Foreign investors need approval from the FIRB before purchasing residential property. This approval is necessary for all types of residential property acquisitions.

2️⃣ Property Ownership:
Foreign investors are generally restricted to purchasing new or pre-construction residential properties. Ownership of existing residential properties by foreign investors is limited and requires FIRB approval.

3️⃣ A Temporary Resident:
Temporary residents holding certain visa types may be permitted to buy one established residential property to use as their primary home. The property must be sold when their visa expires or they cease to use it as their primary residence.

4️⃣ Buying a vacant land:
Foreign investors can buy vacant residential land for the purpose of building a new dwelling. The construction must begin within one to two years of purchasing the land.

5️⃣ Requirements in the contract:
Contracts for property purchases by foreign investors must include a specific clause indicating that the sale is subject to FIRB approval within a specified timeframe.

6️⃣ Consider a financing:
Foreigners usually can't secure financing from Australian banks for property investments. Malaysians may access financing from local banks or Australian private lenders for the investments.

7️⃣ Appoint a legal representative:
It's essential for foreign investors to be represented by a lawyer for the reviewing of contracts, guiding you through the purchase process, and acts as a legal representative in property matters.

As a part of the Government’s COVID Debt Repayment Plan, the Victorian Government has announced a series of land tax increases that will apply for a 10 year period starting from 1st January 2024.

Notably, the absentee owner surcharge will be applicable to Victorian land for a land tax year if the owner is an “absentee owner” (a natural person absentee, absentee corporation or absentee trust).

This surcharge is 4% from the 2024 land tax year (previously 2% for 2020 to 2023, 1.5% for 2017 to 2019, and 0.5% for the 2016 land tax years). Find out what are the changes here.
