CUKAI KEUNTUNGAN HARTA TANAH

-Penentuan harga perolehan hartanah yang dimiliki sebelum 1 Jan 2013 adalah harga pasaran hartanah tersebut pada 1 Jan 2013

-Sebelum ini bagi hartanah yang dibeli sebelum 1 Jan 2000 maka ianya akan mengambilkira harga pasaran hartanah pada tarikh 1 Jan 2000 sebagai harga pemilikan atau harga kos.

-Cadangan baru ini akan mengurangkan amaun cukai keuntungan hartanah yang perlu dibayar terutamanya bagi hartanah yang telah dimiliki sebelum 1 Jan 2000.

-Sebagai contoh Ali membeli sebidang tanah pada tahun 1990 dengan harga RM500,000. Pada Jan 2020, Ali menjual tanah tersebut dengan harga RM RM 2,000,000.

-Harga pasaran pada 1 Jan 2000 adalah RM 1,000,000 manakala harga pasaran bagi 1 Jan 2013 p**a adalah RM 1,600,000. Berikut adalah pengiraan Cukai Keuntungan Harta Tanah (CKHT) tanpa mengambilkira lain-lain kos yang layak ditolak.

Sebelum Bajet 2020 :
RM 2,000,000 – RM 1,000,000 = RM 1,000,000
CKHT = RM 1,000,000 x 5% : RM 50,000

Selepas Bajet 2020
RM 2,000,000 – RM 1,600,000 = RM 400,000
CKHT=RM 400,000 x 5% : RM 20,000

-Ia menghasilkan penjimatan CKHT berjumlah RM30,000. Justeru langkah ini mungkin boleh merancakkan pasaran hartanah di negara ini.

-Bayangkan penjimatan daripada cadangan bagi sesebuah syarikat yang pastinya lebih besar implikasinya kerana kadar minimum cukainya adalah 10%.

-Tarikh efektif cadangan ini adalah pada 11 Oktober 2019. Bermakna ia sudahpun dilaksanakan.

-Satu persoalan yang mungkin belum ada jawapan tepat adalah bagaimana atau siapa yang berhak menentukan nilai pasaran? Setakat ini apa yang kita tahu LHDN akan mengambil nilai pasaran hartanah dari JPPH.
