How much is the stamp duty for a tenancy agreement?

The stamp duty for a tenancy agreement is payable by the tenant. The stamp duty for a tenancy agreement in Malaysia is calculated as the following:

1-year tenancy agreement

RM1 for every RM250 of the annual rental above RM2,400. The stamp duty is free if the annual rental is below RM2,400.

Tenancy agreement between 1 to 3 years

RM2 for every RM250 of the annual rent above RM2,400. The stamp duty is free if the annual rental is below RM2,400.

To make things easier, you can follow this formula:

Stamp Duty Calculation example:

If you want to rent out your unit at RM1,700 per month, your annual rental would be RM20,400 (RM1,700 per month x 12 months).
As the first RM2,400 is exempted from stamp duty, the taxable rental amount would be RM18,000 (RM20,400– RM2,400).
The stamp duty would be charged according to the duration of the tenancy (refer to the amounts at the start of this segment).
As the case for this example (rent of RM1,700 per month), the final stamp duty fee is as the following:

1 year or less:
[(1700 x 12) – 2400]/ 250 x RM1 = RM72

The additional copy of the stamped tenancy agreement is RM10.

> 1 to 3 years:
[(1700 x 12) – 2400]/ 250 x RM2 = RM144

It is best to get original copies stamped for each party; one for the tenant, one for the landlord, and another one for the agent (if applicable). Also note that if the amount you get after you deduct the exemption of RM2,400 from the rental per annum is NOT a multiple of 250, you need to round that figure up to the nearest (and highest) 250.

Location plays a major role in how do you determine the value of a rental property. It has a direct impact on a person’s life and lifestyle of choice.The closer the property is to business spots and workplaces, as well as to amenities, the higher the expected price. Accessibility to the location also plays a major factor. Real estate tends to get even more expensive around the city centre.

2. Type of accommodation
This might seem obvious but the type of accommodation also matters. This is especially true if two different types of property are located in the same area. Therefore, a landed house to have a higher rental rate than an apartment in the same location.

One of the reasons for the higher prices is the size factor. A bigger property area usually means a more expensive price. Do also consider if the property has any extra rooms such as an extra toilet or private bath in every room. It may be valuable, and you may get to charge a higher rent.

3. Facilities

People generally don’t mind paying more if the property comes fully furnished with an air-conditioner, washing machine, and dryer. It makes life easier for people to move in. The interior design of the property also matters. In fact, studies show that it is more appealing to renters to the extent that it “dilutes” the effect of the property location.

5. Parking space
According to the 2017 Malaysia Auto Consumer Finance Study, the average Malaysian household owns two cars. When you factor in guests who are visiting or sleeping over, then the value of extra car spaces increases exponentially. This is especially true if the property is close to the heart of the city, as parking space is hard to find.

Everyone wants to earn a high rental yield. The average rental yield will differ depending on the location, area, and type of property. In Malaysia, a rental yield of around 4-5% is generally accepted as a decent amount.

Gross rental yield formula

Here’s a simple example of how to use a rental yield calculator for a property with the following figures:

Purchase price of property inclusive of all related cost = RM500,000
Rental income per month = RM2,000
Annual rental income= RM2,000 X 12 = RM24,000
Total maintenance cost = RM3,600
Following the previous gross rental yield formula:

(Total rental income per annum/purchase price of the property, inclusive of all related cost) X 100), we will get the following:

(RM24,000/RM500,000) X 100 = 4.8%

On the other hand, following the previous net rental yield formula:

(Total rental income per annum – total maintenance cost/purchase price of the property, inclusive of all related cost) X 100, we will get the following:

(RM24,000 – RM3,600/RM500,000) X 100 = 4.08%

As we can see from the calculation examples above, both rental yields are above the national average of 4-5%. You can derive your estimated rental rate easily by checking out the average rents of properties in the neighbourhood. A rental yield also allows you to know if the rent you are charging is reasonable, or if it is time to review your rates.

What is rental yield?
