Hai semua, salam Jumaat yg barakah 🤲 Harini fiza nak share skit psal 2 jenis status pemilikan tanah yg kita perlu amek tau kalau nak beli @ jual rumah/hartanah i.e. freehold dan leasehold.

Milikan tanah di Malaysia ni dilindungi oleh Kanun Tanah Negara 1965.

Jadi apa dua2 milikan ni?

Milikan tanah kekal (selama-lamanya) - Seksyen 76 Kanun Tanah Negara 1965

Milikan tanah utk tempoh 99 tahun shj - Seksyen 76 Kanun Tanah Negara 1965

Persoalan yang timbul semestinya: Adakah tanah jenis freehold ni mempunyai berbanding leasehold? Jawapannya 'ya' dan 'tidak'.

- Pertamanya, sbb apabila hartanah yg dimiliki dgn status freehold ni mmg milik kita selama-lamanya. Kedua, kerana proses jual beli melibatkan hartanah berstatus freehold adalah lebih pantas berbanding leasehold.

- Pertama, kebiasaannya hartanah yg berstatus leasehold ni terletak di lokasi yg strategik, terutamanya di KL dan Selangor ni. Kedua, tidak perlu risau sekiranya tempoh 99 tahun tersebut tamat, kerana kita boleh memohon utk memperbaharui tempoh tersebut drpd kerajaan negeri dgn membayar 'premium' tertentu (jumlah premium adalah berbeza-beza tertakluk kpd pengiraan mengikut negeri tersendiri).

Kita juga perlu juga ambil tahu bhw kedua-dua tanah jenis freehold dan leasehold ini boleh terdiri drpd 'bumi lot' atau 'non-bumi lot'. Utk bumi lot, hanya bumipitera** shj yg boleh membeli hartanah tersebut, manakala utk non-bumi lot, bumiputera dan non-bumiputera kedua-duanya boleh membeli hartanah tersebut.

Justeru, bg Kak Yong, mmglah penting utk tau status sesebuah rumah/tanah, tetapi ianya bukanlah sesuatu yg konklusif. Masih ada 'pros' dan 'cons' utk kedua-duanya. Cuma, awas sekiranya tanah tersebut berstatus 'Malay Reserve' ataupun Tanah Rezab Melayu kerana tanah jenis ini mmg khas utk org melayu semenanjung shj. Kak Yong akan terangkan pasal ni secara terperinci di post yg lain ok.

** bumiputera bermaksud semua suku kaum orang asli melayu (menurut takrifan Perlembagaan Persekutuan), peribumi Sabah dan peribumi Sarawak.
