Jenis Sekatan Zon dalam Hartanah

1. Sekatan Kepentingan (Restriction in Interest)

Contoh biasa dalam geran:

“Tanah ini tidak boleh dipindah milik, digadai atau digadai janji tanpa kebenaran Pihak Berkuasa Negeri.”

“Tanah ini hanya boleh dipindah milik kepada Bumiputera sahaja.”
➝ Maksudnya kalau nak jual/beli, kena mohon kelulusan dulu.

2. Kategori Kegunaan Tanah (Zoning / Land Use Category)

Ditentukan oleh Pejabat Tanah/JPBD. Biasanya ada 3 kategori utama:

Bangunan (Perumahan / Komersial / Industri)

Pertanian

Tanah Rezab (contoh: Rezab Melayu, Rezab Awam)
➝ Kalau tanah kategori pertanian, anda tak boleh bina rumah kediaman tanpa tukar syarat guna tanah.

3. Syarat Nyata (Express Condition)

Syarat spesifik yang ditulis dalam geran, contoh:

“Tanah ini hendaklah digunakan untuk kediaman sahaja.”

“Tanah ini hendaklah digunakan untuk tujuan pertanian kelapa sawit sahaja.”
➝ Kalau langgar syarat, pihak berkuasa boleh kenakan tindakan (kompaun / tarik balik hak milik).

Ada juga kawasan yang diwartakan khas, contohnya:

Rezab sungai / tasik (tak boleh bina rumah dekat tebing).

Kawasan sensitif alam sekitar.

Kawasan industri berat vs perumahan.
