Buying a house under joint name β your wife automatically own it when you passes away.
π₯ Many couples think:
βWe bought the house together and are paying the loan together. If my partner passes away, of course the house will be mine.β
β Completely wrong!
In Malaysia, the reality is much harsher than most people realise.
Imagine this π
You and your spouse buy a house together, pay mortgage loans with your hard earned money together..
One day, your partner suddenly passes awayβ¦
You continue paying the loan faithfully πΈ
But when you finally finish paying it off β you find out the house is not actually yours.
According to the Distribution Act 1958,
π If thereβs no will, when your spouse passes away, their half of the property will be distributed like this:
πΉ 50% goes to the children
πΉ 25% goes to your late spouseβs parents (your in-laws)
πΉ 25% goes to you
Sounds okay? Not reallyβ¦
Hereβs where things get complicated β
If your in-laws also donβt have a will, their 25% share can be passed down to your brothers/sisters-in-lawβ¦
Now the house becomes:
β‘οΈ Owned by multiple family members
β‘οΈ To sell, every single one must agree & sign
β‘οΈ If even one disagrees β youβre stuck
The house becomes a shared asset,
and your love story turns into a shared dispute. π
So donβt just focus on buying a house together.
The real protection lies in planning who inherits it.

Do proper estate planning
Only then can you truly protect the portion youβve worked so hard to pay for.
Donβt let the day come when β youβve finished paying off the loan, but the house ends up belonging to someone else.
