🎯 What's the difference between Estate Agents & Negotiators 🎯
🌟 With the recent whirlwind of government interventions to ensure that property buyers are well served and not cheated when making a transaction, property salespersons are now required to produce a REN Tag and REN registration number upon introducing themselves, and failure to produce one could end up in a lawsuit.
🌟 The general public are muddled by the many designations being used by property salespersons.
🌟 PropSocial has decided to clear the air a little by collaborating with an experienced Estate Agent, who was kind enough to contribute the following article. We bring to you an article on the differences between an Estate Agent and a Negotiator.
🎈 What's the difference between Estate Agents & Negotiators ?
➡ To the general public, there seems to be no distinction to the two designations as they are used interchangeably. The fact of the matter is that there is indeed a stark distinction between the two and they are elaborated in detail below.

🎈 Who is an estate agent ?
➡ In Malaysia, the estate agent’s profession is governed by the Valuers, Appraisers and Estate Agents Act 1981 【Act 242】 and is supplemented with rules made under the Valuers, Appraisers and Estate Agents Rules 1986.

➡ The Act provides for the setting up of the Board of Valuers, Appraisers and Estate Agents 【BOVAEA】 which regulates the estate agency profession. The functions of the Board include determining and regulating the professional conduct and ethics of valuers, appraisers and estate agents and the setting of standards of professional practice.

➡ A registered estate agent as defined in the Act is a person whose name has been entered under Part III of the Register and to whom an authority to practice has been issued by the Board under Section 16.

➡ “Estate Agency Practice” as defined in the Act means acting or holding oneself out to the public or to any individual or firm as ready to act, for a commission, fee, reward or other consideration, as an agent in respect of the sale or other disposal of land and buildings and of any interest therein or the purchase or other acquisition of land and buildings and of any interest therein or in respect of the leasing or letting of land and buildings and of any interest therein including the act of making known of the availability of land, building or any interest therein for such sale or other disposal, purchase or other acquisition, leasing or letting.

➡ The law governing the estate agent’s profession can be found in the Valuers, Appraisers and Estate Agents Act 1981 【Act 242】. The Act in fact came into force on 06 February 1981. At the time it governed only the professions of Valuers and Appraisers and the Act governing them was known as the Valuers and Appraisers Act 1981.

➡ In 1984 in response to a critical need to regulate the estate agency profession as a result of unprofessional practices by unregulated people carrying out estate agency activities, the Act was amended to incorporate the profession of estate agency and hence it was known as the Valuers, Appraisers and Estate Agents Amendment Act 1984 which came into force on 7 September 1984.

➡ The passing of the amended Act means that BOVAEA was required to keep and maintain a separate Register for Estate Agents.

➡ It is interesting to note that there is also a distinction between a valuer and an appraiser. Under section 20 of the Act 242, there are restrictions imposed on registered appraisers such as being subject to a total capital value and restriction of practice to a particular State/ States. The Valuers however are not subject to the same restrictions.

➡ A Valuer’s registration number is denoted with a V followed by a few digits while an Appraiser is denoted with an A followed by a few digits.

➡ To be eligible to be registered as an estate agent, one would be required to pass the Board’s Written Estate Agents Examination Part 1 and 2 and the Test of Professional Competence 【TPC】

➡ An estate agent’s registration number is denoted by E followed by a few digits.Once a person becomes a registered estate agent, he/ she is then able to establish his/ her own real estate agency practice via forming a body corporate, a partnership or a sole proprietorship.

🎈 Who is a negotiator ?
➡ It is worth noting that there is no mention of the word ‘Negotiator’ in Act 242 nor in the Valuers, Appraisers and Estate Agents Rules 1986.

➡ It was not until the coming into force of the Malaysian Estate Agency Standards 【MEAS】 that the term ‘negotiator’ was mentioned. MEAS was first introduced on 1 September 1999 and this was subsequently superseded by the new MEAS which came into force on 1 June 2014.

➡ A negotiator as defined by the MEAS is a person who is either employed or engaged on a ‘contract of service’ or on ‘a contract for service’ by a firm to list and market properties and shall always be under the immediate direction and supervision of an estate agent. By this it means that a negotiator cannot work independently and must be always under the supervision of an estate agent.

➡ Currently, it is mandatory for anyone who wishes to become a negotiator to undertake the 2 Day Negotiator Certification Course 【NCC】, which is an intensive two day training course. This is a prerequisite to formal registration as a negotiator with BOVAEA where one will be given a tag together with a REN Number - REN follow by 5 digits 【e.g. REN 02259】. REN is an acronym for Real Estate Negotiator. A negotiator must wear the Tag during the course of their business and the REN number must be stated in all forms of promotional and marketing materials.

🌟 政府以确保购房者在进行交易时得到良好的服务并不会受骗,因此房地产销售员如今在自我介绍时都必须佩带产业经纪识别证 【REN Tag】 和产业经纪注册编号,未能展示出产业经纪识别证和产业经纪注册编号的人士可以招来诉讼。
🌟 房地产销售员所使用的多种名称可能都懵了一般的大众。所以与一名经验丰富的房地产经纪联手协作,写出以下文章来消除大众的疑虑。我们将在这篇文章里说明地产经纪 【Estate Agent】 和地产协商者 【Negotiator】 的差异。
🎈 地产经纪人和地产协商者之间有什么区别?
➡ 对一般的大众人士来说,这两个称号由于时常被互换使用而似乎没有任何区别。但是事实上,这两者之间却有着鲜明的区别,他们的区别将在下文详细被论述。
🎈 谁是一名地产经纪?
➡ 在马来西亚,地产经纪行业是由1981年估值师、估价师及地产代理法案 【法案242】 管辖;并辅以1986年估值师、估价师及地产代理规则下所订立的规则。

➡ 该法案促使了大马估值师、估价师及地产代理局【BOVAEA】 的设立,来监管地产代理行业。该委员会的职能包括确定和规范估值师、估价师和房地产经纪人的专业操守和职业道德,以及制定专业标准。

➡ 一名已注册的地产经纪在该法案中的定义是一个姓名已被输入登记册第III部分的人,和其执业权已根据该局的第16条文发出。

➡ 该法规定 “地产代理执业” 是经纪人在售卖或处置土地和建筑物或其他权益上,或在购买土地和建筑物或其他权益上,或在出租或租赁土地和建筑物或其他权益上, 向公众或任何个人或公司准备给予服务,以换取佣金、费用、报酬或其他代价;当中的服务行为包括让大众知道该出售或以其他方法处置、购买或以其他方法收购、租赁或出租的土地和建筑物或其他权益的可得性。

➡ 管制地产经纪行业的法律可以在1981年的估值师、估价师及地产代理法案 【法案242】 中找到。该法案于1981年2月6日生效。当时,该法案只管辖估值师和估价师的行业,而被称之为1981年估值师和估价师法案。

➡ 在1984年时,为了应对管制地产经纪行业的迫切需要,以制止不受监管的人作出不专业的地产中介活动,该法案被修订而纳入了地产经纪的专业。自此以后,它被称为1984年估值师、估价师及地产代理法案,生效于1984年9月7日。修订的法案被通过后,BOVAEA 就必须保存和保持一个专为地产经纪而设的登记册。

➡ 有趣的一点是,估值师 【Valuer】 和估价师【Appraiser】 之间其实也有区别。根据242法案的第20条文,已注册的估价师受制于总资本价值和区域的限制。然而,估值师并不受相同的限制。估值师的注册编号由V字母开始,后方跟着几个数字;而估价师的则是由A字母开始,后方附有几个数字。

➡ 若要被注册为一名地产经纪,那就必须通过该局地产经纪笔试的第1和第2部分,以及TPC测验 【 Test of Professional Competence】。地产经纪的注册编号为E开始,后面随着几个数字。一个人一旦成为了已注册的房地产经纪人,他/她就能够通过形成法人团体、合伙、或独资公司来建立出自己的地产经纪实务。

🎈 谁是一名地产协商者?
➡ 值得注意的是,在242法案内和1986年估值师、估价师及地产代理规则里并不存在 ‘地产协商者’ 的记载。直到 MEAS 【Malaysian Estate Agency Standards】 生效后,才出现了 ‘地产协商者’。MEAS首次推出于1999年9月1日,后来被2014年6月1日生效的新MEAS取代。

➡ 地产协商者被MEAS定义为一名由公司以“服务合同”雇用或聘用的人,随时随刻需在一名地产经纪人的指导和监督下列出和营销房地产。这一点代表地产协商者不能独自工作,必须随时有地产经纪人监督。

➡ 目前,希望成为房地产协商者的人都强制性地必须上维持两天的NCC课程 【2 Day Negotiator Certification Course】,这是一个两天长的强化培训班。这是要与BOVAEA正式注册为地产协商者的先决条件。一位地产协商者会拥有一个有REN编号的识别证 -REN 随后有5个数字 【例如:REN02259】。REN 是地产协商者英文字,Real Estate Negotiator 的缩写。地产协商者在进行业务的过程中都必须随身携带这个识别证,而REN编号都必须被显示在所有形式的促销和营销材料。
