ERCAAN Strengthens Ties with Kwara State Housing Corporation to Enhance Real Estate Practice

In a bid to further solidify its collaboration with the Kwara State Housing Corporation, the Estate Rent Commission Agents Association of Nigeria (ERCAAN), Kwara State Chapter, paid a strategic courtesy visit* to the corporation yesterday. The delegation, led by the State Chairman, Hon. Adewole Onibokun (EFA), alongside four other executives, engaged in high-level discussions aimed at fostering a more structured and professional real estate practice in the state.

The open-door meeting, presided over by the General Manager of the Kwara State Housing Corporation, ESV Ibrahim Ramat, alongside senior officials of the corporation, centered on enhancing regulatory compliance, streamlining property transactions, and facilitating the formal registration of ERCAAN members under the corporation.

In her address, the GM emphasized the importance of professionalism, ethical standards, and due diligence in the real estate sector. She encouraged ERCAAN members to uphold integrity in property transactions, stressing that a well-regulated real estate sector contributes significantly to urban development and economic stability. She also reaffirmed the corporation’s commitment to supporting ERCAAN in its mission to promote standard real estate practices across Kwara State.

Senior officials of the corporation provided insights into the agency’s objectives, policies, and frameworks, underscoring how ERCAAN can complement government efforts in transforming Kwara State into a real estate investment hub. They also highlighted the numerous benefits of the collaboration, including access to verified property listings, legal protections for agents and clients, and increased opportunities for professional development.

The one-hour meeting, held between 1:00 PM and 2:00 PM, had a total of 12 participants in attendance. Both parties expressed optimism that the strengthened partnership will lead to a more structured, transparent, and investor-friendly real estate sector in Kwara State.

This engagement marks another milestone in ERCAAN’s continued efforts to advance real estate professionalism, enhance regulatory adherence, and create a conducive environment for property transactions in the state.

Land documents refer to the various legal instruments or documents that are used to establish and transfer ownership rights of landed property.

In Nigeria, we have alot of land documents affecting the transfer of land ownership and legal interest in a property. As a realtor and client it's necessary to get acquainted with these documents.

All documents are not mandatory or relevant to all properties, an appropriate document for any property transaction will be determined by the nature or circumstance of the property.

βœ… 𝐏𝐔𝐑𝐂𝐇𝐀𝐒𝐄 π‘π„π‚π„πˆππ“

A land purchase receipt is a normal receipt or document reflecting the receipt of payment for a particular property or land. The seller issues the receipt to the buyer. However, the receipt does not transfer the title of the land.

βœ… π‚πŽππ“π‘π€π‚π“ πŽπ… 𝐒𝐀𝐋𝐄 πŽπ… 𝐋𝐀𝐍𝐃:

This documents is used to show an agreement of sale of land from the seller to the buyer. It is relevant when any property is being purchased by anyone. It is not an instrument of township, and must be preceded with other document transferring title in the applicable property.

βœ… π’π”π‘π•π„π˜ 𝐏𝐋𝐀𝐍:

A survey plan is used to show the location and size of landed property. With the descriptions and coordinates on the survey document, it is easier to check or search from the office of the Surveyor-General whether the land is actually under any government acquisition or not. It most times called registered survey.

βœ… 𝐃𝐄𝐄𝐃 πŽπ… π€π’π’πˆπ†ππŒπ„ππ“:

Deed of Assignment or Deed of Conveyance is used in sales transactions to permanently transfer a landed property from the seller (also known as assignor) to the buyer (also refers to as assignee). It must be drafted by a lawyer, signed by the seller, buyers and their witnesses. In a simpler terms, it transfers the title or ownership of the land or property from the seller to the buyer. Without a deed of assignment you don't own the land.

βœ… π‚π„π‘π“πˆπ…πˆπ‚π€π“π„ πŽπ… πŽπ‚π‚π”ππ€ππ‚π˜ (𝐂 𝐨𝐟 𝐎):

This is usually issued by the state government, indicating that a person owns a parcel of land or property. It is issued to individuals or companies. State governments also give it to the allottee of the government's land. An Individual who subsequently takes over land by way of sale does not require a new certificate of occupancy but rather a deed of assignment with the governor's consent.
This document last for 99 years, and can be renewed.

βœ… 𝐃𝐄𝐄𝐃 πŽπ… πŒπŽπ‘π“π†π€π†π„:

Deed of mortgage is actually used in mortgage transactions to show that land or property has been transferred from the mortgagor (borrower) to the mortgagee (lender). It is a temporary transfer in the sense that the mortgagor shall be entitled to retrieve this property back from the lender when the total loan amount, together with the accrued interest, has been paid.

βœ… 𝐃𝐄𝐄𝐃 πŽπ… π†πˆπ…π“:

It is a document that proves that land or property has been gifted from one person (Donor) to another (Donee). A deed of gift can be used to transfer interest in a landed property.

βœ… π‰π”πƒπ†π„πŒπ„ππ“ πŽπ… π‚πŽπ”π‘π“:

The judgment of a court is another essential document which may affect or transfer an interest in a specific property from one person to another. In Nigeria, the legal interests in several properties have been transferred from one person to another through the decisions of various courts. When property ownership has been derived through litigation or any property has been subjected to a lawsuit, it is essential to examine the full decision of the court in respect of such property by obtaining a copy of the judgement.

I b0ught a Land 5 yrs ago and i have built three bed room on it and am living there with my family.

Atanda, i was planning to prepare the C of O only to discover that another person has gotten the C of O of my land 9 yrs ago.

Atanda, pls what can i do at this point?

My Reply;

Hmmmm.
Oga, make Atanda just tell you the plain truth.

You don enter one chance.
You don go build h0use on top another person Land.
In fact, you never build h0use o, because the 0wner of the land is the 0wner of the house under the Law.
So at this point, you need to find the real 0wner with the C of O and Buy the Land from him officially again, but that is if he agrees to sell it o.

If e say No. Say him no dey sell.
Just go and remove your h0use from his Land.
That's all

This is why i do tell people that before you buy Land from Omonile or RΒ£al Estate C0mpanies.
Take the Land information to the Bureau of Land in your state to do your own personal research about the Pr0perty.

Na there the whole secret go come out.
