When your landlord serves you a Quit Notice (a "Notice to Quit") in Nigeria, it may feel like the end of your rent obligations β but legally, it doesnβt cancel what you owe. 1. What Is a Quit Notice in Nigeria β and Is It Valid?
Under Nigerian tenancy law (e.g., the Lagos State Rent Control and Recovery of Residential Premises Law), a Quit Notice must be written down, signed, and contain essential details: the landlordβs name, your name, the property address, and a clear termination date.
The length of notice depends on your tenancy type. For example:
Weekly Tenancy β at least 1 week notice
Monthly Tenancy β at least 1 month notice
Yearly Tenancy β at least 6 months notice
After the Quit Notice expires, your landlord must usually issue a 7-day notice of ownerβs intention to recover possession before going to court.
2. Important Reality: Quit Notice β Rent Waiver
Even when a Quit Notice is served, the landlord is still fully entitled to your rent for the period you remain in the property.
In Nigerian court decisions, this principle is well-established. For instance, in CHISCO TRANSPORT (Nig) Ltd v. Njoku, the court affirmed that collecting rent after serving a valid Quit Notice does not invalidate the notice.
Also, the Supreme Court has held that unless a new tenancy agreement is created, the original Quit Notice remains effective even after rent is accepted.
3. Why This Matters β & What You Should Do
Donβt stop paying rent: When you stay in the property after a Quit Notice, legally you are still a tenant until you vacate.
Get proof of payment: Always demand and keep rent receipts. Under Nigerian law, you have the right to a receipt showing the amount, date, and period covered.
Know your rights: If the notice you were served is defective (wrong dates, missing key information), it could be challenged.
Seek legal advice: If you feel the Quit Notice was improperly issued, or your landlord is threatening eviction, speak with a lawyer.
4. Bottom Line (for Nigerian Tenants)
A Quit Notice is a formal signal that your landlord wants you to leave β but it does not automatically relieve you from paying rent.
