On Monday, we asked:
If a house is given as a gift but the recipient is handed a Power of Attorney, does that automatically make them the legal owner?
The answer:
NO — not by the Power of Attorney alone.
A Power of Attorney generally gives someone authority to act on behalf of another person. It is not, standing alone, the ordinary instrument for transferring ownership of property.
This is why property documentation must be understood, not simply received.
Before committing your money or relying on a document, verify the underlying title, the appropriate transfer instrument and any applicable consent, registration and perfection requirements.
The real lesson:
A document can give you authority without giving you ownership.
Don’t just look at the document.
Understand what right it actually gives you.
