ESSENTIAL THINGS YOU MUST DO AFTER BUYING LAND.

Don’t just buy land and fold your arms waiting for 15-20 years to sell it at a higher price.

Before you purchase a piece of land, there are 3 things you should note…

1. Acquisition
2. Documentation
3. Possession.

After you acquire a piece of property, in this case land, you get the documents that proofs you’re the owner of the said property.

The next line of action is to TAKE POSSESSION. Always take possession of every piece of land you buy. It is your investment, you just protect it.

Possession is ultimate in this part of the world. This is something they may not teach you in those real estate trainings you attend.

Don’t abandon your land because you have documents. You may be in for the shocker of your life in the near future. This is especially if you buy land inside a layout or from a community.

If you’re buying land inside a proposed estate, or in a village or community, it is always good to take possession of your property either by installing very visible beacons, corner-piece, dwarf fence or whatever that would ward off trespassers.

THE TROUBLE WITH THE LAND USE ACT OF 1978.

The Land Use Act was promulgated on 29th March, 1978 as the principal legislation on land administration in Nigeria. The Act circumscribed the absolute ownership right and freehold interest over lands in Nigeria by vesting all lands comprised in the territory of each State (except lands vested in the Federal Government or its agencies) solely in the Governor of the State, who will hold such Lands in trust for the people and will be responsible for allocation of lands in all urban areas to individuals and organizations, while similar powers were conferred on Local Governments with respect to non-urban areas.

It introduced a weaker and usufructuary interest called “Right of Occupancy”, whilst ultimately derogating the primacy of property rights, namely; right to use, sell, pledge (mortgage), bequeath and (with limitation) destroy same as one may deem fit, which rights are primordially associated to land ownership.

Right of Occupancy is right sui generis, described as right to the use and occupation of land, and evidenced in the Certificate of Occupancy issued for a definite period, usually for 99 years.

The Act by the provisions of Section 28 also empowered the governor to revoke Right of Occupancy after issuance, for public interest.

This, unfortunately, avails governors the power to use the paraphernalia of office to pursue private vendetta by speculative compulsory acquisition, which if the land is undeveloped will attract no compensation.

Regrettably, wanton abuse of this power has occasioned several lost of properties and money from the formal title holders.

The governor after revoking the right over a land, may start a project just to be abandoned immediately or reallocate same land to a highest bidder for self aggrandizement.
