LAGOS TENANCY BILL 2025: WHAT YOU SHOULD KNOW!

The Lagos State Tenancy and Recovery of Premises Bill 2025 is here to reform housing laws and protect both tenants and landlords. Hereโ€™s a quick breakdown of the major changes:

๐Ÿ”น Applies Statewide โ€“ No more area exemptions like in the 2011 Law. The new Bill covers all of Lagos, urban and rural (with limited exceptions).

๐Ÿ”น Agent Regulation โ€“ All agents must register with LASRERA. Collecting rent from multiple tenants for one property is now a criminal offence. Max agent fee: 5%.

๐Ÿ”น Rent Caps โ€“ No more than 3 months' rent in advance for monthly tenancies and 1 year for annual tenancies. Violations attract fines or jail time.

๐Ÿ”น Faster Evictions โ€“ No need for โ€œNotice to Quitโ€ if tenant owes rent beyond the grace period. Just a 7-day eviction notice required.

๐Ÿ”น Court Requirements โ€“ Tenants must show proof of rent and utility payment to file or appeal cases.

๐Ÿ”น Virtual Hearings โ€“ Disputes can now be heard online to save time and increase access.

๐Ÿ”น Challenge Unfair Rent Increases โ€“ Tenants can take landlords to court over unreasonable rent hikes, and canโ€™t be evicted while the case is ongoing.

Donโ€™t let anybody confuse you again. Know the difference between these land documents:

Power of Attorney, Deed of Conveyance, Deed OF Gift and Deed of Assignment.

Many people just hear โ€œbring paper, sign paperโ€ and they rush. But do you know the difference?

1. Power of Attorney:
You are not the owner, you are just standing in gap. Someone gives you the power to act or sign on their behalf. Tomorrow, they can cancel it.

2. Deed of Conveyance:
This one is transfer of ownership. From A to B, legally and permanently. Land don change hand.

3. Deed of Gift:
No buying, no selling. Pure love. Owner just says โ€œtake, itโ€™s yours.โ€ But it must still be documented legally.

4. Deed of Assignment:
When land/house is sold, this is the paper that shows the buyer is now the owner. Itโ€™s like handing over your receipt of ownership.

In short:

Power of Attorney is Borrowed authority

Conveyance is Ownership transfer

Gift is Free transfer

Assignment is Sale transfer.

Donโ€™t confuse them.

A lawyer that collects less than 10% for property work is not a lawyer, heโ€™s an agent in disguise.

Pay your lawyer 10% or prepare to pay 100% for prรธblรซms later.

When you buy land or house, remember the lawyer is not a beggar.

Pay your lawyer 10% of the market value of that property

If you can pay agent 10%, why canโ€™t you pay your lawyer 10% too?

After all, itโ€™s the lawyer that will save you from buying land that belongs to a ghost, a government, or a family land that 50 people will come and claim tomorrow.

Pay your lawyer well, unless you want to buy trouble with receipt.
