- Harmony, style, feeling and expression are to be freely made by developers in designing their buildings. However, only those approved by the Estate Architects will be allowed.
- Actual positioning of buildings on plots requires the prior approval of the supervising architects to meet approved standards. A time frame of two years is prescribed for every purchaser of a plot to develop and occupy his/her property. IMPORTANT UPDATES FOR NOVEMBER 2021 FOR OLD VICTIMS OF PLOT FRAUDS
The following updates are in response to enquiries which project managers have continued to receive from persons who claim to have lost money to land tricksters and thieves around the Estate between 2016 and 2020:-
1. ON OPTIONS STILL OPEN TO PERSONS TO RECOVER THEIR LOSSES. The attention of such victims is hereby drawn to the final orders of Owerri High Court in Contempt Proceeding No. HOW/290M/2019 in which the lead fraudsters were the 1st Set of Respondents. On October 14, 2021 the court ordered against them thus:-
“The contemnors shall within 14 days comply with the judgment in Suit No. HOW/320/2006 by quitting the subject land (i.e. Plot P.10 Egbu/Uratta layout Owerri and also replacing all survey beacons and other structures of the Judgment Beneficiary/Applicant destroyed/demolished by the 1st Set of Respondents while in contempt of the judgment in Suit No. HOW/320/2006”.
“Refund the purchase price and all monies they may have demanded and received from third parties to whom they purportedly sold plots of the subject land whilke in contempt of the judgment in Suit No. HOW/320/2006”.
“Order of perpetual injunction is made restraining the 1st Set of Respondents, their Heirs, Privies, Assigns, Customers, Clients, Developers, Town Union Officials, Youth officials, etc from any further entering of the subject property and/or interfering in any manner whatsoever in the Judgment Beneficiary/Applicant’s management or development of Plot P.10 Egbu/Uratta Layout Owerri”.
2. The court also ordered the Commissioner of Police Imo State, the Director Department of State Services and the Economic & Financial Crimes Commission (EFCC) “to take all necessary steps in exercise of their statutory powers and ensure that members of the public are not further fleeced by the 1st Set of Respondents in contempt of the judgment in Suit No. HOW/320/2006”.
3. ON WHETHER IT IS TRUE THAT THE LAND FRAUDSTERS HAVE PENDING APPEALS ON THE JUDGMENTS AND ORDERS OF COURT OBTAINED AGAINST THEM:-
There is no pending appeal, whether at the Court of Appeal or at the Supreme Court, against the Owerri High Court judgment in Suit No. HOW/320/2006, given on 10th July 2007, This was the judgment which vested the rights of occupancy of the entire Estate land on the trust corporation. Even by 31st January 2007, the time allowed for a constitutional appeal against the judgment had long elapsed. There is also no pending appeal against the Owerri High Court judgment in Suit No. HOW/583/2018, given on 6th September 2018. This judgment vested possession of the entire Estate land on the trust corporation. The time for an appeal has also long elapsed. Neither is there any pending appeal against the Owerri High Court orders in Suit No. HOW/583/2018 by which all illegal developers forfeited their structures to ONHEL since 16th September 2019.
