It might seem like a good way to protect yourself, but landlords can’t add clauses that override the Residential Tenancies Act.

If a clause conflicts with the law, it’s unenforceable, and in some cases it may even be illegal.

The Act sets the rules that both landlords and tenants must follow, and private agreements can’t remove those protections.

For example, screening can reveal things like:

📜 Tenancy Tribunal decisions
Published Tribunal cases may show past issues such as rent arrears, property damage, or breaches of the Residential Tenancies Act.

📰 News and media reports
Occasionally reports involving fraud, violence, or serious misconduct may surface during a background search.

⚖️ Court or enforcement records

🏡 Our property managers are reporting that tenant demand is easing, which is quite normal as we enter the cooler months. The number of enquiries and people attending viewings has reduced, however we are still seeing reasonable numbers through properties when they first become available.

Some properties are still being let within the first week, but once we get past this initial flush, it is becoming harder to find the right tenant. We expect this market trend to continue through winter.

Rent prices remain steady, although rents may need to be adjusted the longer a property remains vacant.

There are still good numbers of properties available, so tenants do have a choice.

As a landlord, the key is to listen to feedback from tenants attending viewings and to adjust the rent or carry out maintenance that makes the property more desirable and helps attract the best possible tenant.
