🏠 Who can give notice to enter a rental property?

It doesn’t have to come directly from the property owner.

Under the Residential Tenancies Act 1986, the definition of a landlord includes an authorised agent - meaning a property manager can issue a valid entry notice and enter the property on the landlord’s behalf.

However, all requirements under section 48 must still be followed, including the correct notice period, permitted entry times and lawful reason for entering.

Section 48 covers entry for routine inspections, repairs and maintenance, emergencies, Healthy Homes and smoke alarm compliance, suspected abandonment, property viewings and other specific circumstances.

The full wording of section 48 can be found in the Residential Tenancies Act 1986 on the New Zealand Legislation website.

Knowing who can issue notice - and when entry is legally permitted - helps protect both landlords and tenants 🔑

An ingoing inspection is more than a few photos 📸

Using a 360° camera means I can create a detailed record of the property before a tenant moves in — but I also make sure the little things are documented.

✨ Lights on AND off
🪟 Blinds open AND closed
🚪 Drawers and cupboards opened
🔍 Fixtures, fittings and condition captured in detail

Why go to this much effort?

Because months (or years!) later, we shouldn’t have to rely on anyone’s memory to determine what condition something was in at the start of the tenancy.

A thorough ingoing report protects both the landlord and the tenant and makes the end-of-tenancy process a whole lot easier.
