A defective cross-lease title is more common than you might think. If your home, garage, deck, extension, or other structures don't match the building outlines shown on your Flats Plan, your title may be defective. 😬

Why does it matter? A defective title can create issues when selling your property and may make lenders reluctant to approve finance.

What you need to know about updating a Flats Plan 👇

✅ CONSENT
Under current legislation, any lease longer than 35 years is treated as a subdivision. That means updating a Flats Plan isn’t simple — it requires subdivision consent from Council.

✅ AGREEMENT
Even if only one unit is affected, all landowners on the cross-lease titles are involved. Everyone must become signatories and agree before the process can even begin.

✅ ALTERATIONS
Updating the Flats Plan doesn’t change the ownership structure — the property remains a cross lease, with the same neighbour controls and restrictions. Any future additions or alterations to building outlines? You’ll need to go through this process all over again to rectify it.
