A few years back, someone came to me. Fully paid na daw siya sa binili niyang property at may notarized Deed of Absolute Sale na.

โ€œSir, may next step pa ba dito?โ€ tanong niya sakin.

Then when I checked the document, I noticed: more than 10 years old na ang notarial date.

I asked if alam niya na posible nang magkaroon ng ๐ฉ๐ž๐ง๐š๐ฅ๐ญ๐ข๐ž๐ฌ sa pag-register nya ng ownership ng property.
๐Ÿ˜ฌ Hindi daw. He was shocked at the huge amount โ€” and asked what the legal basis was.

Today, ito yung pag-uusapan natin.

May Notarized Deed of Sale na at fully paid na sa seller โ€” ako na ba ang official owner?

๐Ÿ‘‰ Answer: Hindi pa.

Under Sec. 51 of P.D. 1529 (Property Registration Decree):

A notarized DOAS only serves as a contract between parties.

The โ€œoperative actโ€ that transfers ownership is the registration of that deed with the Registry of Deeds.

Kailangan bang magbayad muna ng taxes bago ma-register ang property?

๐Ÿ‘‰ Answer: Yes.

Under the NIRC and LGC, property registration requires Tax Compliance with (if sale):

โ— Capital Gains Tax
โ— Documentary Stamp Tax
โ— Transfer Tax
