Revilla filed Senate Resolution No. 410 a day after Albay representative Joey Salceda proposed the imposition of tax on Netflix and Facebook ads, among other Internet firms, as a way of generating revenues for the government.

He stated that some of the most technologically-advanced countries such as Norway, Australia, Japan, France, South Korea, United Kingdom, Singapore, and Malaysia have already adopted and passed their respective versions of digital service tax laws which enable them to collect taxes from local consumption and use of digital content and services from foreign providers.

The lawmaker also pointed out that the establishment of a digital taxation framework is among the strategies recommended by the Inter-Agency Task Force Technical Working Group (IATF TWG) for Anticipatory and Forward Planning.

“We need to embrace the digital revolution of our time, and to comprehensively review and update our existing tax laws regarding digital economy,” Revilla said.

Even before the Covid-19 pandemic, Philippine digital economy was expected to grow by more than 250% from $7 billion to $25 billion by 2025, equivalent to 5.3 percent of country’s gross domestic product (GDP).

Revilla noted that Filipinos are known as voracious online users, typically spending around 10 hours and two minutes of their time in the internet, exceeding the global average online time of six hours and 42 minutes daily. Filipinos spend around four hours and 12 minutes on various social media platforms every day, nearly double the global daily average of two hours and 16 minutes. Filipinos spend at least 3.3 hours daily watching online content on mobile devices.

The lawmaker said revenues raised from such taxes could be used to finance the national economic recovery plan, especially the rehabilitation of severely affected industries, and the construction of “Schools for the Future” which are equipped with digital technologies and laboratories.

“Habang patuloy po ang pagpapatupad natin ng quarantine measures tulad ng social distancing at pagbabawal sa mass gathering, at sa pagpasok nga po natin doon sa tinatawag na ‘New Normal,’ tiyak pong mas marami tayong kababayan na gagamit ng technology-based services tulad ng mga online streaming at online market,” Revilla said.

Revilla said that while local online businesses have already been covered by taxation laws, multinational corporations with more sophisticated technological capabilities, less physical presence yet wider reach may have to be properly taxed given the outdated provisions and leakages in our tax measures.

The Bureau of Internal Revenue (BIR) has issued Revenue Memorandum Circular No. 55-2013 reminding the taxpayers’ obligations in relation to online business transactions including online shopping or online retailing, online intermediary service, online advertisement/classified ads, and online auction.

He further cited multilateral efforts at unifying tax rules regarding digital economy, such as the one led by the Organization for Economic Co-operation and Development (OECD), to address overlaps with individual state measures and avoid double taxation, considering the borderless nature of such transactions.

SA PUNONG LALAWIGAN

“Ang Lalawigan ng Bulacan, ay naunang nakasama sa General Community Quarantine (GCQ) noong Mayo 11, 2020. Noong Mayo 13, 2020, ang inyong lingkod, kasabay ng iba pang Gobernador sa Central Luzon, ay naghain ng kahilingan sa Regional at National Inter-Agency Task Force on Emerging and Infectious Diseases (IATF-EID) na mabigyan pa ng extension upang manatili sa Enhanced Community Quarantine (ECQ). Kaugnay nito, matapos ang validation ng Regional at National IATF-MEID, opisyal kong ipinababatid na ang Lalawigan ng Bulacan, ay pinahintulutan na malipat sa MODIFIED ENHANCED COMMUNITY QUARANTINE (MECQ) mula Mayo 16 hanggang Mayo 31, 2020.

• Una sa lahat ay taos-pusong pasasalamat sa ating mahal na Pangulong Rodrigo Roa Duterte at sa Regional at National IATF-EID sa kanilang pang unawa at maagap na pagtugon sa ating kahilingan.

• Nauunawaan at pinahahalagahan ko ang layunin ng GCQ na mapagaan ang mga paghihigpit at unti-unting mabuksan ang ating ekonomiya. Ang lalawigan ng Bulacan, sa ating nagkakaisang laban sa COVID-19, ay may pinakamababang rate of infection sa lahat ng lalawigang nakapaligid sa National Capital Region. Gayunpaman, humiling tayo ng higit pang panahon sapagkat ang ating lalawigan ay nasa mga unang yugto pa lamang ng mass testing na lubhang mahalaga upang lubusan nating masugpo ang pandemya.

• Dama ko ang inyong pagtitiis at paghihirap subalit kailangan kong magdesisyon kung ano ang pinakamabuti para sa lahat. Bilang inyong Gobernador, sinumpaan kong tungkulin na pangalagaan ang kalusugan at kaligtasan ng bawat Bulakenyo. Ayaw po natin na masayang ang lahat ng ating pinaghirapan sa nakalipas na ilang buwan. Ang layunin natin ay makapaghanda ng higit pa ang ating lalawigan bago lumipat sa General Community Quarantine.

• Kailangan natin ng mas malinaw na datos ng paglaganap ng COVID-19 infection sa ating mga nasasakupan sa pamamagitan ng mass testing. Sa ganitong paraan, mas magiging madali para sa ating mga lokal na pamahalaan ang paggawa ng mga hakbang at pagbabalangkas ng mga protocol upang makaiwas sa second wave of infection gaya ng nararanasan ngayon sa ibang panig ng daigdig. Para sa isang bansang tulad ng Pilipinas, hindi kakayanin ng ating health care system ang biglaang pagsiklab ng “second wave of virus infection”. Hindi tayo magpapadalos-dalos sa puntong ito, sa halip ay titiyaking may sapat na basehan ang bawat pagdedesisyon. Buhay po nating lahat ang nakasalalay dito. Iisa lamang ang buhay na ipinagkaloob ng Panginoon sa atin at sa sandaling mawala ay hindi na kailanman maibabalik.

• Sa karagdagang panahong ipinahintulot sa atin, ang Pamahalaang Panlalawigan ay nagsasagawa pa ng mass swabbing ng ating probable at suspect cases, medical frontliners at iba pa. Pinasimulan natin ito sa pagpasok sa isang Laboratory Testing Agreement sa Philippine Red Cross noong May 8, 2020, habang inaantay ang nalalapit na pagbubukas ng ating sariling Bulacan Molecular Laboratory Testing Center. Nagbukas na ang Bulacan Infection Control Center, isang COVID treatment facility na nagsimula nang tumanggap ng Covid-19 patients, open 24-7 with free health care, free meals, sa mga airconditioned rooms. Nagdagdag din tayo ng Quarantine Facilities sa lalawigan at maging sa bayan-bayan.

• Ito rin ang panahon upang ihanda ang bawat sektor sa unti-unting pagbalik sa “new normal” na daloy ng buhay. Malaking sakripisyo ang hinihiling sa atin. Sa lahat ng aspeto ay mayroong malaking pagbabago, mula sa ating personal na pakikitungo sa kapwa hanggang sa paraan ng ating pamumuhay. Mahigpit ko pong itinatagubilin ang ibayong pag-iingat, pagtalima sa batas at disiplina ng lahat sa ilalim ng MECQ. Makakaasa po kayo sa mahahalagang impormasyon, pakikipag-ugnayan at ang mga paggabay na ating patuloy na ihahatid para sa iba’t ibang sektor ng ating lalawigan.

• Ang pandemyang ito ay maaaring naglayo sa atin sa pisikal na paraan, ngunit naglapit sa ating mga puso at damdamin sa nagkakaisang laban sa COVID-19.

• Nagbabalik sa ating ala-ala ang mga yugto ng kasaysayan kung saan ang lalawigang ito ay paulit-ulit na tinawag sa kabayanihan, at minsan man ay hindi nagdalawang-isip ng pagtugon, taglay ang matibay na pananampalataya sa Diyos, pagmamahal sa pamilya, at pagkalinga sa kapwa.

• Walang pagsubok na hindi natin nalampasan sa mga nagdaang panahon. Lumaban tayo sa lahat ng pagsubok na may matibay na pananalampalataya sa Panginoon. Ang pandemyang ito ay digmaan ng ating henerasyon. Kung tayo ay magtutulungan, lalawakan ang pang-unawa at ilalagak ang ating buong pagtitiwala sa patnubay at pagliligtas ng Dakilang Diyos, buo ang aking pag-asa na ito ay ating malalagpasan.
