"You can't stop people from living a normal life because sound is part of everyday living."
ANCOP has never ADVOCATED for a COMPLETELY SILENT WORLD. SOUND is a natural part of life. People talk. Babies cry. Children play. Dogs bark. Families listen to music. Communities celebrate. These are all normal human activities.
HOWEVER, there is an important distinction that both SCIENCE and the LAW recognize:
SOUND is any AUDIBLE VIBRATION. It BECOMES NOISE when it is UNWANTED, EXCESSIVE, UNNECESSARY, UNREASONABLE, or HARMFUL, ESPECIALLY when it INTERFERES with another person's HEALTH, COMFORT, SLEEP, WORK, or PEACEFUL ENJOYMENT of their home.
This is not merely ANCOP's opinion it is RECOGNIZED by Philippine law.
Article 694 of the Civil Code DEFINES a NUISANCE as ANYTHING that ANNOYS or OFFENDS the SENSES, INJURES HEALTH, ENDANGERS LIFE or SAFETY, or INTERFERES with the USE and ENJOYMENT of property.
Our ADVOCACY is also SUPPORTED by EXISTING LAWS and ENVIRONMENTAL REGULATIONS, INCLUDING:
• Republic Act No. 8749 (Philippine Clean Air Act)
• Presidential Decree No. 1152 (Philippine Environment Code)
• NPCC Memorandum Circular No. 002-1980, which PROVIDES ALLOWABLE ENVIRONMENTAL NOISE LEVELS for DIFFERENT AREAS, INCLUDING RESIDENTIAL COMMUNITIES.
These STANDARDS EXIST because EXCESSIVE ENVIRONMENTAL NOISE is RECOGNIZED as a PUBLIC HEALTH CONCERN.
ORDINARY SOUNDS of daily life are NOT THE TARGET of our ADVOCACY.
It is when SOUND BECOMES CONTINUOUS, EXCESSIVE, INTENTIONALLY AMPLIFIED, or UNNECESSARILY LOUD to the POINT that it DEPRIVES NEIGHBORS OF SLEEP, DISTURBS their PEACE, AFFECTS their HEALTH, or PREVENTS them from PEACEFULLY ENJOYING their own homes, it may already BECOME a NUISANCE UNDER the LAW.
ANCOP also does not PROMOTE BULLYING, HARASSMENT, or INTIMIDATION.
We believe that COMPLAINTS MUST BE SUPPORTED by FACTS, EVIDENCE, PROPER DOCUMENTATION, and DUE PROCESS. False accusations have no place in responsible advocacy.
Some ask, "Can you name a place that follows this advocacy?"
Yes. Many countries including Singapore, Japan, Germany, Australia, and several European nations have environmental noise regulations. They are not silent countries. People still live normal lives. They simply recognize that one person's freedom ends where another person's right to health, peace, and privacy begins.
Our advocacy is simple:
We are NOT FIGHTING AGAINST SOUND.
We are FIGHTING AGAINST EXCESSIVE, UNNECESSARY, and HARMFUL NOISE that AFFECTS PEOPLE'S HEALTH, WELL-BEING, and QUALITY of life.
RESPECT is a two-way street. We all have the freedom to live our lives but we also have the RESPONSIBILITY not to UNREASONABLY DISTURBS the lives of others.
A PEACEFUL COMMUNITY is not a silent community. It is a COMMUNITY WHERE FREEDOM and RESPONSIBILITY EXIST together.
ANCOP's POSITION: We Are AGAINST HARMFUL NOISE, NOT NORMAL LIVING.
FREEDOM to Make SOUND Comes with RESPONSIBILITY.
NORMAL SOUNDS Are PART of LIFE. EXCESSIVE NOISE Is NOT.
SOUND Is Not the ENEMY EXCESSIVE NOISE IS.
