Before buying any Real Estate Property, it is necessary to exercise Due Deligence to protect your interest as well as avoid unnecessary limbo that will put your investment to waste.
Here are some documents that you have to check prior to buying such any Real Estate For whatever purpose.
1. Certified True Copy of Title.
The title is best evidence for ownership. It contains 4 pages or more. The 1st two pages contains the details of the owner as well as the exact details about the lot or condo unit. The remainder is space allocated for Annotations. Make sure that it is clear from any Annotations that may include les pendens or counter claim.
2. Certified True Copy of Tax Declaration
Secondary reference of ownership. Also contains details such as boundaries and land classification.
3. For Untitled Lots. (Tax Dec Only)
A. Status Clearance from DENR. This will tell if the lot you purchase is alienable and disposable, as well as no disputes.
4. Regional Trial Court Clearance.
This will verify if the title is being subjected to any civil or criminal cases.
5. DAR clearance. For Agricultural Lands such as Farms or Orchards, verify that the land is not subject to any agrarian reform claims.
6. City Engineering and City Planning Road Right of way Clearance. For property that is landlocked or the access roads are still private and or still subjected to subdivision.
