This presentation is intended only as reference on the basic rates, deadlines, penalties and designated Government offices to where the taxes be paid.

Below are the basic taxes that we encounter in the sale and transfer of real estate. This is applicable only on assets classified as "Capital Assets".

1. Capital Gains Tax
✔Rate: 6% of Sale of Lot (per Deed of Sale), 6% per Zonal Value (BIR Zonal), 6% of Assessed value (per Tax Declaration) whichever is "HIGHER".
✔Date of Payment: Within 30 days from the date of Notarization of the Deed of Sale.
✔Penalty: Payment after said date shall be subject to 25% penalty.
✔Where to Pay: Authorized Agent Bank

2. Documentary Stamp Tax on Sales
✔Rate: 1.5% of Sale of Lot (per Deed of Sale), 1.5% of Zonal Value (BIR Zonal), 1.5 of Assessed Value (per Tax Declaration) whichever is "HIGHER".
✔Date of Payment: 5th day following the month when the document was notarized.
✔Penalty: 25% of basic tax
✔Where to pay: Authorized Agent Bank

3. Transfer Tax
✔Rate:Not more than 1% of Sale of Lot (per Deed of Sale), BIR Zonal Value whichever is "HIGHER"
✔Date of Payment: 60 days from date of ex*****on
✔Penalty: 25% surcharge plus + 2% penalty per month not more than 36 months
✔Where to pay: City/Provincial Treasurers Office

4. Registration Fee
✔Rate: Refer to Registration Fee Table
✔Date of Payment: After taxes on the sale of property have been paid and CAR has been secured from BIR
✔Where to pay: Designated Register of Deeds
