One of the most common neighborhood conflicts inside subdivisions is house extensions built too close to the road.
A question I often get:
“If this happens inside a subdivision, can the government still take action?”
The answer is YES.
Even if the road is inside a subdivision, construction must still comply with the National Building Code of the Philippines and is monitored by the Office of the Building Official.
Most residential properties are required to maintain minimum setbacks from the road. If a structure is built too close — for example only 0.5 meter from the road — it could be considered a violation.
Here’s what you can do if you encounter this situation:
1️⃣ Verify first. Check if the neighbor has an approved building permit and plans.
2️⃣ Talk to the neighbor. Sometimes the contractor made a mistake or the owner was unaware.
3️⃣ Report to the Homeowners Association. Subdivisions usually have architectural guidelines and setback rules.
4️⃣ File a complaint with the Office of the Building Official
They can inspect the property and issue a Notice of Violation or Stop Work Order if necessary.

Even inside private subdivisions, building rules and road easements still apply.
Before extending your house, always check:

• approved plans
• building permits
