RECTO LAW vs MACEDA LAW
Know your rights when buying on installment.

Many Filipinos buy property or vehicles through installment payments. However, when the buyer fails to pay, the seller cannot just do whatever they want. The law provides protection to buyers through two important laws: Recto Law and Maceda Law.

Let us simplify them.



RECTO LAW (Article 1484 of the Civil Code)
This law applies when you buy personal property on installment, such as:

• Cars
• Motorcycles
• Appliances
• Equipment
• Gadgets

In short, movable property.

If the buyer fails to pay installments, the seller has ONLY THREE OPTIONS under the law:
1. Exact fulfillment
The seller may demand payment of the unpaid installments.
2. Cancel the sale
The seller may cancel the contract if the buyer fails to pay at least two installments.
3. Foreclosure of the chattel mortgage
If the property is mortgaged (for example, a car loan), the seller may foreclose the mortgage.

BUT HERE IS THE IMPORTANT PART:

If the seller chooses foreclosure, the seller can no longer collect any remaining balance from the buyer.

This is called the prohibition on deficiency judgment.

Illustration

You bought a car worth ₱1,000,000.

You already paid ₱300,000, but you stopped paying.

The seller repossessed the car and sold it at auction for ₱500,000.

There is still a balance of ₱200,000.

Under the Recto Law, the seller can no longer collect the ₱200,000 deficiency from the buyer if foreclosure was chosen.

This rule prevents abusive practices by financing companies.



MACEDA LAW (RA 6552)
Also known as the Realty Installment Buyer Protection Act.

This law applies to real estate sold on installment, such as:

• House and lot
• Condominium units
• Residential lots

The law protects buyers who have already paid installments.

Your rights depend on how long you have been paying.



If you have paid LESS THAN 2 YEARS

You are entitled to:

• A grace period of 60 days to pay the unpaid installment.
• If you still fail to pay after the grace period, the seller may cancel the contract.



If you have paid AT LEAST 2 YEARS

You have stronger protection.

You are entitled to:
1. Grace Period

One month grace period for every year of installment payments.

Example:

If you paid for 5 years, you are entitled to 5 months grace period.

2. Cash Surrender Value

If the contract is cancelled, the seller must refund at least 50% of the total payments made.

If you paid more than 5 years, the refund increases by 5% per year, up to 90% maximum.



Illustration

You bought a house and lot worth ₱2,000,000.

You paid installments for 6 years totaling ₱900,000.

If the contract is cancelled:

Minimum refund:

50% of ₱900,000
= ₱450,000

Since you paid more than 5 years, there may be additional percentages depending on the computation.

This prevents developers from simply cancelling the contract and keeping all payments.

Seller cannot collect the remaining balance after foreclosure

Maceda Law
Buyer is entitled to refunds and grace periods



Important Reminder

Many buyers do not know their rights. Sometimes financing companies or developers threaten buyers with actions that are not allowed by law.

If you bought a car, motorcycle, house, or lot on installment and are experiencing problems with the seller or financing company, it is best to know your legal rights before agreeing to anything.

WATCHOUT| Davao City shall soon experience a world-class transport system with the MetroDavao route tier through DavaoBus.

MetroDavao will be the highest tier of bus routes which will form the core services connecting all the major commercial centers along five routes with high frequency, all-day services, with bus stops spaced strategically between central business districts (CBDs).

The routes under this tier will utilize 18-meter articulated electric bus, ensuring an efficient and environmentally-friendly mass transportation.

LOOK | DAVAO CITY’S ICONIC 1.340 KM DAVAO RIVER (BUCANA) BRIDGE IS NOW 73% COMPLETE

The construction of the 1.340-kilometer Davao River (Bucana) Bridge continues to move forward ahead of the target completion as the 4 pairs of stay cables have been installed on the 2nd pylon of the bridge. According to Senior Undersecretary Emil K. Sadain of the Department of Public Works and Highways (DPWH), it will be passable on the 3rd quarter of 2025—less than 2 years since the construction started.

The Bucana Bridge Project costs ₱3.126 billion—which involves the construction of a 4-lane 6-span extradosed bridge, connection road, traffic engineering, lighting, and other ancillary facilities. Once completed, the Bucana Bridge will accommodate up to 35,000 vehicles daily, improving traffic flow and reducing congestion in Davao City’s coastal areas.

MINDANAO'S ULTRAMODERN MALL IS SET TO OFFICIALLY OPEN ON DECEMBER 2024 - THE NCCC MALL OF DAVAO 🦅

NCCC Mall Ma-a is a Davao-Based and homegrown mall of Davao City—moving forward towards modernity. NCCC Malls will be investing around PHP 4 billion for the construction of the ultramodern NCCC Mall Ma-a, which is expected to be completed by December 2024. This mall will have a 100,700 sqm. of Gross Floor Area (GFA), making it the 6th largest mall in the city.
Designed by Asya Design, the building facade of the mall embodies the habitat and way of life of the iconic Philippine Eagle. The new NCCC Mall Ma-a will have four floors and a basement parking. Among its features include The Nest skyline view, The Nook Asian-themed food court, Sky Gymnasium, and Entertainment Zone with cinemas, arcade, and bowling alleys.

Beware of the word “CLEAN TITLE”

You can only call it clean title IF:

⭕ Owners that appears in the title of the property are still ALIVE & CAN SIGN documents

⭕ NO disputes attached in the title AND “certified true copy” of the title.
Please take note of the word “AND” because not all disputes are printed in the original title itself. Thus, it is very important to request for the latest certified true copy of the title.

⭕ All real estate taxes are paid on time. Always request for latest real estate tax clearance.

⭕ If the owners are married (on or after 1987) the property is considered conjugal even if only one property owner is in the title. Both should sign sale documents. Should the property owner dies, heirs should file and pay for the estate tax of all the properties.

⭕ If the property estate taxes are not yet paid, the property cannot be called “CLEAN”.

⭕ Magkaiba po ang real estate tax na binabayaran ninyo annually at ang estate tax (BIR FORM 1801). You only pay estate tax if the owner in the title is already dead. Penalties (like big penalties) apply for late filing.

👨‍🏫Answer:

BARE Units have NO TILES, NO ROOM PARTITIONS, NO CEILINGS, NO PAINT or PRIMARY COAT ONLY.

Pros: YOU ARE YOUR OWN DESIGNER. If you love doing the nitty-gritties of house essentials and you have a skill in haggling prices, you will definitely enjoy. And, you get to choose what type of tiles and paint colors to use. Ofcourse, AT YOU OWN COST. Woohoo!!!

Cons: YOU DO ALL THE LEG WORKS. You look for contractors/construction workers. You monitor the workers and the house progress. You monitor the materials needed. You pay them in either daily, weekly, or the "pakyaw" basis. * haaayyyysss*

COMPLETE Units are sometimes called "finished" units. Floor tiles are already in placed, walls are painted with several coatings, partition walls are also mounted.

Pros: STRESS-FREE. Upon turnover period, you only have to apply for water and electricity connections. All you have to bring are your furnitures, appliances, clothings and other essentials...

Cons: YOU TAKE IT .. You don't choose your TILES of choice, the paint color, and the way how the rooms are partitioned. But, hey! Worry not. Lahat naman ito pinag-isipan, binabagay ayon sa kung ano ang akma sa textura at kulay.

So, ano na? Which do you prefer?
