BAGONG ADMINISTRATIVE ORDER NG LTO REGARDING "IMMEDIATE TRANSFER OF OWNERSHIP" DATED AUG. 30, 2024
1. Nirerequire ang Seller/Owner na ireport sa LTO through online submission or pumunta sa LTO office ang sales transaction within 5 days after ng bentahan.
2. Dapat i-process kaagad ng Buyer ang transfer of ownership sa LTO within 20 days from the date of notary sa deed of sale.
3. Failure to report and process transfer will have a penalty of 20k for both Seller & Buyer, LTO will also tag alarm on the motor vehicle or motorcycle, pati yong driver's license ng mga involved parties.
Kakapanood ko lang kanina sa Ted Failon at DJ Chacha on RPTV. Ngayon ko lang nalaman itong bagong batas na ito. At dahil October 21 na, ibig sabihin nyan ay ang mga magre-report na sa LTO ng mga ganitong transaksyon ay posible ng patawan ng 20k na multa. Pero case to case basis daw. dahil sya lng ang nag benta at di sang-ayon ang iba

pwede pa po bang mababawi ang property na nabenta?

Sa ilalim ng Civil Code ng Pilipinas, partikular na sa Article 493, ang pagmamay-ari ng isang ari-arian na hindi pa nahahati o naipapamana ng maayos (undivided estate) ay tinatawag na "co-ownership." Sa ganitong sitwasyon, ang anumang transaksyon ukol sa ari-arian, tulad ng pagbenta, ay nangangailangan ng pagsang-ayon ng lahat ng co-owners o heirs.
Ayon dito, "Each co-owner shall have the full ownership of his part and of the fruits and benefits pertaining thereto, and he may therefore alienate, assign or mortgage it, and even substitute another person in its enjoyment, except when personal rights are involved. But the effect of the alienation or the mortgage, with respect to the co-owners, shall be limited to the portion which may be allotted to him in the division upon the termination of the co-ownership."
Paano maging Valid ang Bentahan:
1. Pagsang-ayon ng Lahat ng Heirs: Kailangan ng pirma at pagsang-ayon ng lahat ng co-owners o heirs para maging valid ang bentahan.
2. Legal na Proseso:Dapat dumaan sa tamang legal na proseso at magkaroon ng notarized na dokumento na nagpapakita ng pagsang-ayon ng lahat.
Pagbawi ng Ari-arian:
Kung hindi sumang-ayon ang ibang heirs sa pagbenta ng ari-arian, maaaring ideklara itong invalid. Upang mabawi ang lupa, maaaring maghain ng kaso sa korte upang ideklara ang bentahan na walang bisa at hilingin na maibalik ang ari-arian sa mga heirs.
Mga Hakbang Para Mabawi ang Ari-arian:
1. Maghain ng Kaso sa Korte: Kailangan ninyong maghain ng kaso sa Regional Trial Court (RTC) upang ideklara na invalid ang pagbenta ng property.
2. Pagpakita ng Ebidensya: Maghain ng ebidensya na walang pagsang-ayon mula sa ibang heirs at walang tamang legal na proseso ng pag-apruba ang naganap.
3. Hilingin ang Reversion ng Ari-arian: Sa inyong petisyon, hilingin na maibalik ang ari-arian sa inyo at sa iba pang heirs. - Mister Broker
