Ikaw ba ay may pag aaring lupa, condo o bahay at lupa. Alam mo ba puwede mo na ito ilipat or ipamana sa pamamagitan ng "Deed of Donation"
What are the 2 types of Deed of donation?
The two (2) basic classifications of donations are Mortis Causa and Inter Vivos. The former shall take effect during the lifetime of the donor, but the property shall not be delivered till after death of the donor's death.
1.Causa mortis is a Latin term referring to the awareness that death is approaching. In property law, when a party, acting with awareness that their death is approaching, gives something to another party, the resulting gift is known as a gift causa mortis.
2. Inter vivos is a Latin phrase which means “while alive” or “between the living.” This phrase is primarily used in property law and refers to various legal actions taken by a given person while still alive, such as giving gifts, creating trusts, or conveying property.
Ano ang kagandahan sa maagang pagpapalipat or pagpapamana ang "tax" ay mas mababa dahil ang "zonal value" ay magbabase kung kailan ito lilipat. Dahil sa "zonal value" nagbabase ang BIR hindi sa "Deed of donation" o "Deed of Sale".
Mas mura kung ngayon kesa kung pagdating pa or pagkamatay ng nag mamay ari ng lupa.
Pag namatay ang nag mamay-ari magiging dalawang tax ang babayaran ang Estate Tax , Donor Tax. Tapos "Documentary Stamp Tax "sa pagpapalipat ng pangalan na binabayaran din sa BIR.
