📍 ANG TITULO AY SUPREMO
Kung ang lupa mo ay may Torrens Title, hindi ito makukuha ng kahit sino sa pamamagitan lang ng pagtira doon—kahit 20 o 50 taon pa silang nakatira. Registered land is protected by law!

📍 POSSESSION ≠ OWNERSHIP
Ang pag-okupa ay hindi pagmamay-ari. Hangga't nasa pangalan mo ang titulo at nagbabayad ka ng amilyar (Real Property Tax), ikaw ang legal na may-ari.

📍 HUWAG MATULOG SA KARAPATAN

Pede ko bang ipa-survey ang lupa namin kahit hindi pa kami nagkakasundo ng mga kapatid ko sa hatian? 🤔

Ito ang madalas na tanong pagdating sa usaping mana. Ang maikling sagot: Opo, pwedeng-pwede. Ang pagpapa-survey (Relocation Survey) ay ginagawa para malaman ang saktong sukat at boundaries ng lupa. Hindi nito kailangan ang pirma ng lahat ng tagapagmana kung ang layunin ay malaman lang ang sakop ng property. Pero tandaan, iba ang survey sa Subdivision Plan na kailangan ng pirma ng lahat para sa tuluyang paghahati ng titulo.

LIMA KAMING MAGKAKAPATID NA NAGMANA NG ‘MOTHER TITLE.’ PAANO ITO MAHAHATI? 🏠👨‍👩‍👧‍👦
Ito ang isa sa pinakamadalas na tanong sa amin. Maraming pamilya ang may hawak na Mother Title—isang malaking lupa na nakapangalan pa sa mga magulang o ninuno—pero hindi alam kung paano kukuha ng sariling titulo ang bawat anak.

Huwag hayaang mauwi sa away o kalituhan ang inyong mana! Narito ang tamang legal na proseso para ma-subdivide ang lupa:

Ang Step-by-Step na Proseso:
1️⃣ Extrajudicial Settlement (EJS):
Dapat magkasundo ang lahat ng limang magkakapatid. Gagawa ng dokumento (EJS with Partition) kung saan nakasaad kung paano hahatiin ang property. Lahat ay kailangang pumirma at kailangang i-notaryo ito.

2️⃣ Subdivision Survey:
Dito kailangan ang PRC Licensed Geodetic Engineer. Sila ang susukat sa lupa at gagawa ng Subdivision Plan. Dito itatakda ang eksaktong hangganan o boundary ng bawat kapatid base sa napagkasunduan.

3️⃣ Approval of Survey Plan:
Ang ginawang plano ng engineer ay ipapasa sa DENR (LMS) o LRA para ma-approve. Ito ang magiging basehan para magkaroon ng "Lot Number" ang bawat parte.

4️⃣ BIR & Estate Tax:
Kailangang bayaran ang kaukulang Estate Tax sa BIR. Ito ay mahalagang step para makakuha ng Certificate Authorizing Registration (CAR).

5️⃣ Registration of Individual Titles:
Kapag kumpleto na ang papers, dadalhin ito sa Register of Deeds. Sila ang mag-ka-cancel sa Mother Title at maglalabas ng limang (5) bagong Transfer Certificate of Title (TCT)—isa para sa bawat kapatid!

💡 Mahalagang Paalala:
Huwag maghati-hati sa pamamagitan ng "turo-turo" lang. Siguraduhing dumaan sa lisensyadong Geodetic Engineer para iwas-overlap at iwas-problema sa hinaharap.

Ang maikling sagot: OO, PWEDE! ✅

Huwag hayaang mapigilan ang pagpapa-survey dahil lang wala sa iyo ang original copy ng titulo. Narito ang kailangan mong malaman:

1️⃣ Photocopy is Enough: Maaaring gamitin ng isang Licensed Geodetic Engineer ang malinaw na photocopy ng titulo para makuha ang "Technical Description" (sukat at bearings) ng iyong lupa.

2️⃣ Technical Description at LRA/DENR Records: Ang mga propesyonal na surveyors ay may access sa mga official records sa Land Registration Authority (LRA) o Department of Environment and Natural Resources (DENR) kung saan nakatago ang mga aprubadong survey plans.

3️⃣ Certification: Ang photocopy ay sapat na basehan para sa isang surveyor na makapaglabas ng certified survey plan, lalo na para sa mga legal purposes o kung balak mong mag-apply para sa reconstitution ng titulo.

Kaya kung may planong ipa-survey ang lupa, huwag mag-atubiling kumuha ng isang Licensed Geodetic Engineer! 📐🏠

Sabi ni Lolo, doon daw sa may puno ng mangga ang boundary kasi doon daw siya nakatali ang kalabaw niya noong 1950. Siya na daw ang bahala, 'wag na daw dumaan sa surveyor kasi "memoryado" na niya ang bawat kanto ng lupa. 🌳🤔

Sa totoo lang, bilib tayo sa talas ng memorya ni Lolo, pero paano na 'yung technical description sa Titulo? Mahirap na ang "sabi-sabi" baka sa huli, sa barangay pa ang tuloy!
