“Ma’am, the property is still mortgaged to Pag-IBIG.”

For some buyers, that sentence is enough to make them walk away.

And honestly, I understand why.

When you're preparing to pay millions of pesos for a property, you want certainty. You want a clean title. You want to know that the property you are buying is truly transferable to you and that there won't be an existing obligation attached to it.

But here's something every property buyer should understand:

A property being currently mortgaged to Pag-IBIG does not automatically mean it is a bad property—or a transaction you should immediately reject.

What matters is how the transaction is structured and how your interests are protected.

A recent situation reminded me of this.
We had a buyer who had already visited the property.

During the site visit, the buyer was informed that the property was still mortgaged through Pag-IBIG.

It wasn't hidden.

It wasn't discovered at the last minute.

The buyer knew.

After seeing the property and discussing the transaction, the buyer agreed to proceed with full payment.

But when the time came to complete the transaction, the buyer suddenly backed out—or, more accurately, disappeared.

The reason?

The property was still mortgaged.

The buyer wanted to pay in cash and receive a clean, unencumbered title immediately.

I completely understand the hesitation.

But this is where proper real estate practice becomes important.

A mortgage does not automatically mean the seller cannot sell.
What it means is that there is an existing obligation secured by the property.

So the transaction needs to be handled properly.

The question shouldn't simply be:

“Is the property mortgaged?”

The better question is:

“What is the process for settling the mortgage and transferring the property to me, and how will my money be protected while that happens?”

That's a very different question.

Here's how I would want the transaction structured.
First, payment should be properly documented and made through the bank or the appropriate official payment channel.

Not handed casually to an individual.

Not based solely on verbal promises.

Not simply because someone says, “Don't worry, I'll take care of it.”

There should be a clear paper trail.

Second, the parties should execute the appropriate contract that clearly states the obligations of both buyer and seller.

The agreement should address the existing mortgage, the payment arrangements, the responsibility for settling the loan, and the conditions that must be fulfilled before full conveyance.

Third, the buyer's protection should be built into the transaction.

For example, the Deed of Absolute Sale should only be used for the appropriate stage of the transaction, particularly when the conditions for conveyance have been satisfied and the necessary documents are available.

Once the Pag-IBIG mortgage has been properly settled and the title and required documents are released and ready for transfer, the parties can proceed with the appropriate conveyance and registration process.

The exact documentation and sequence should, of course, be reviewed based on the specific transaction and applicable requirements.

This is why I always tell buyers:
Don't be afraid of a complicated transaction. Be afraid of an undocumented transaction.

A property with an existing mortgage can be perfectly manageable when there is:

✔️ Full disclosure
✔️ Proper documentation
✔️ Verified loan information
✔️ Clear payment instructions
✔️ A defined process for mortgage settlement
✔️ Properly structured contracts
✔️ Clear conditions for the release and transfer of the title
✔️ Professional guidance throughout the transaction

The real danger isn't necessarily the mortgage.

The danger is giving your money without understanding how the mortgage will be settled and how ownership will eventually be transferred to you.

And this is where your real estate broker matters.
A good broker isn't there merely to open the gate, show you the house, and negotiate the price.

A professional broker should help you identify potential issues before you commit your money.

They should help coordinate the parties, make sure important information is disclosed, and help structure the transaction so that both buyer and seller understand their responsibilities.

For the buyer, the goal is protection.

For the seller, the goal is also protection.

Because a properly structured transaction should not leave either party relying on trust alone.

Trust is important. Documentation is better.

So, should you buy a property mortgaged to Pag-IBIG?
Not automatically yes.

Not automatically no.

Investigate first.

Ask:

How much is the outstanding loan?
How will the loan be settled?
Where will my payment go?
What documents will be executed?
When will the title and mortgage annotation be cleared?
What happens if the mortgage cannot be released?
When will the Deed of Absolute Sale be executed?
Who is responsible for each step?
If these questions can be properly answered and documented, the existence of a mortgage does not necessarily make the transaction a bad one.

In fact, many legitimate property transactions involve properties that are still under financing.

The key is due diligence, proper documentation, and professional guidance.

One final lesson from this experience.
As a buyer, you have every right to be cautious.

Please ask questions.

Please verify documents.

Please understand where your money is going.

And if something doesn't make sense, pause before paying.

But don't reject a property solely because you saw the word “MORTGAGED” on the title.

Instead, ask whether there is a safe and properly documented way to resolve that mortgage as part of the sale.

Because in real estate, the goal isn't simply to find a property with a clean title.

The goal is to complete the entire transaction safely—from the first payment to the final transfer of ownership.

And that's one of the reasons why working with a Licensed Real Estate Broker matters.

You shouldn't have to figure out the transaction alone.

Buying property is a major financial decision. Choose a professional who will help protect your investment—not just help you close the deal.
