PAANO NGA BA KUMUHA NG BAHAY?

Paano nga ba gagawin para makakuha ng pabahay?

1. Kailangan natin muna malaman kung ano at magkano ang source of income para malaman agad kung kayo ay pwedeng ma-approve sa isang financing institution. Kung ang income ay minimum wage na Php12,000 monthly, maaari kayong makapag loan worth Php450,000 na bahay o halagang Php3,000-Php4,000 monthly amortization. Kung Php20,000 ang income ang pwedeng monthly amortization ay Php-5,000-Php6,000. Basta po 30% ng Total Income nyo ang pwede nyong maging monthly amortization. Usually ang term ay maximum na 25-30 years. Kung gustong mas maiksi like 5-10 years, tataas din ang monthly amortization pero kung hindi pasok ung income hindi rin ma-approve ung housing loan. Basta ang i-approve nila ay kung saan nagmatch ung income nyo for the amortization. Pero pede din po ang combined salary or co-borrower.

Kung employed ka need mo lang ipakita ang payslip, certificate of employment. Kung nag-bi-b-business ung Income Tax Return. Kung OFWs or Seaman ung job contract at certificate of employment.
Kung wala sa ano mang nabanggit, para sa mga kababayan natin nag sa-sideline or online job na walang binabayaran na tax, maaari kayo makapag-avail cash payment o deferred cash.
Example Php5,000/24 months= Php20,833.33

2. Kailangan natin malaman kung anong financing institution ang gagamitin para makapag-housing loan. Para sa murang pabahay na may mababang monthly ito ay posible para sa mga Pag-IBIG members dahil ang maximum years to pay ay 30 years. Kung hindi Pag-IBIG member pwede kayo makapag-loan thru bank o in-house financing. Hindi lahat ng developer ay may bank financing at in house financing. Kapag ang presyo ng bahay ay lagpas 1Million pataas thru bank financing ang mas advisable.

3. Kailangan natin malaman kung ano ang marital status at citizenship. Kapag foreigner wala pong karapatan sila na makabili o mag-ari ng bahay at lupa unless may asawa silang Pilipino. Para sa mga complicated status foreigner suggested namin na financing at thru in-house financing, dahil mahigpit ang bank at Pag-IBIG sa mga ganitong status.

4. Ano nga ba ang RENT-TO-OWN? Ito po ay payment scheme,ibig sabihin ay maaaring matirhan ang bahay kahit hindi kayo nagbayad ng FULL CASH eg. Php500,000. Iba ang RENT-TO-OWN sa For RENT ONLY, ang RENT-TO-OWN ay FOR SALE. Hindi po ibig sabihin ay malilipatan agad. Ang RENT-TO-OWN ay maaaring LIPAT AGAD o PRESELLING.

5. Ano ang LIPAT AGAD? Basta mabayaran ang required na cash out/equity/down payment pwede nyo na lipatan ang bahay if RFO na at turn over na sa pagibig after 3-6months.

6. Ano ang PRESELLING? Ang preselling ay pagbebenta ng bahay na may licensed to sell na kahit hindi pa tapos or under construction pa ung subdivision. Usually ang turnover ng preselling ay 1-3 years pwede malipatan ang bahay. Ang mga projects selling na low cost housing ay usually nasa PRESELLING STAGE.

The Difference between the Certificate of Title versus Tax Declaration in the Philippines

CERTIFICATE OF TITLE
1. A document evidencing a right of ownership to a property
2. A document that attest to the fact that the person named is the owner of the property described therein subject to liens and encumbrances noted on it
3. It is registered with the Register of Deeds of the province or city where the land is located
4.The Certificate of Title is indefeasible and imprescriptible
5. All claims to the land are quieted upon issuance of this document
6. Recorded with the Register of Deeds of the municipality, city, or province where the land is located.

TAX DECLARATION
1. A document that show good sign of possession only in the concept of owner, not ownership
2. Not conclusive evidence of ownership to property, but only a proof of payment of realty taxes
3. Recorded with the Assessor’s Office of every municipality or city where the land is located

Ang pagmamay-ari ng lupa ay napapatunayan sa pamamagitan na hawak na titulo na kung tawagin ay ang Transfer Certificate of Title (TCT) o Condominium Certificate of Title (CCT). Ayon sa maraming Supreme Court decisions β€œthe best proof of ownership of a piece of land is the Certificate of Title” (Halili vs. Court of Industrial Relations, 257 SCRA 174 [1996]). Ito ang tinatawag na titulo ng lupa at wala nang iba pa.

Ang "tax declaration ay hindi titulo ng lupa. Maraming Supreme Court decision din ang nagsasabi na "Tax declarations and receipts are not conclusive evidence of ownership. At most, they constitute mere prima facie proof of ownership of the property for which taxes have been paid. In the absence of actual, public and adverse possession, the declaration of the land for tax purposes does not prove ownership." Ibig sabihin nito na ang tax declaration ay hindi siguradong ebidensiya ng pagmamay-ari ng lupa. While tax declarations and receipts are not conclusive evidence of ownership and do not prove title to the land.

Ang tax declaration ay pwedeng i-apply para maging titulo. May dalawang pamamaraan ng pagpaparehistro ng lupa, ito ay ang sumusunod:

1. Judicial Proceeding – kung saan kinakailangan ninyong magfile ng petisyon para sa registration sa korte.

2. Administrative Proceeding –ito ay pamamaraan kung saan mag-file ng application para sa β€œHomestead Patent” sa DENR at ang registration ng patent na ito ang magiging batayan para sa pag-isyu ng Original Certificate of Title alinsunod sa Commonwealth Act 141 o ang β€œTHE PUBLIC LAND ACT”.
