Here's the actual process, simplified:

This is non-negotiable. Only a PRC-licensed Geodetic Engineer can prepare the subdivision plan and technical descriptions. They conduct the survey, draw the boundaries of each new lot, and submit the plan for approval. Expect to spend around โฑ20,000โโฑ50,000+ depending on lot size and complexity.

The subdivision plan goes through the DENRโLand Management Bureau, LGU (Planning Office), and the Land Registration Authority (LRA). They check for overlaps with other titled properties and verify compliance with zoning and minimum lot size requirements.
Important distinction here: A ๐ด๐ช๐ฎ๐ฑ๐ญ๐ฆ ๐ด๐ถ๐ฃ๐ฅ๐ช๐ท๐ช๐ด๐ช๐ฐ๐ฏ (no roads or open spaces delineated, usually under 1 hectare) is more straightforward. A ๐ค๐ฐ๐ฎ๐ฑ๐ญ๐ฆ๐น ๐ด๐ถ๐ฃ๐ฅ๐ช๐ท๐ช๐ด๐ช๐ฐ๐ฏ (with streets, open spaces, and amenities) triggers PD 957 requirements โ including registration with DHSUD and obtaining a License to Sell before you can offer lots to buyers.

If a sale or transfer is involved, here's what you'll deal with at BIR:

If subdivision is for donation to family, Donor's Tax applies. For inherited land, Estate Tax clearance comes first.

If you sell a portion of land without a proper subdivision plan and separate title, the buyer has no legal title to register. Worse, under PD 957, selling subdivision lots without a License to Sell (when required) is punishable by fines and even imprisonment. The Philippine Supreme Court has ruled that such sales are ๐ท๐ฐ๐ช๐ฅ๐ข๐ฃ๐ญ๐ฆ โ meaning the buyer can demand a full refund, and the seller can face both administrative and criminal liability.
