HIWALAY SA ASAWA, GUSTO BUMILI NG PROPERTY.

10 years na ako hiwalay sa husband ko. May 3 kaming anak pero nasa akin lahat. Ang asawa ko ay may kinakasama na at meron na ring 2 anak. Ako po ay single pa rin at may magandang kita na ngayon dahil sa sariling pagsisikap. Gusto ko bumili ng mga properties tulad ng lupa at bahay para na rin sa mga anak ko. Ang worry ko, dahil hindi pa kami annulled ng husband ko, magiging part pa ng conjugal property ang mga mabibili kong properties na ayaw ko naman mangyari dahil para iyon sa mga anak ko. Ano po ba ang legal remedies para dito?

To all Real Estate BUYERS & INVESTORS:

DID YOU KNOW? IF you are buying an agricultural land converted and subdivided for residential land, you will be required for a copy of subdivision plan and licenses before you can apply for water, electricity and other utilities? Plus... a required mapped out of the residential drainage system.

That's why it is highly discouraged to buy/sell "Yuta-data-data" most specially if with no LICENSE TO SELL from HLURB. But if you insist because it's the cheapest, BUY AT YOUR OWN RISK PLUS MULTIPLE ADD-ON EXPENSES and hmmm penalties for the sellers.

1. Check the LAND TITLE. The land title contains the total land area of the land you are trying to purchase.

2. The subdivided lot should have the certificate of reclassification from agricultural land to residential land from LGU. You need to check for this inorder to make sure that you will be able to install utilities and apply for them from the providers of the city/municipality.

3. You need to check on subdivision plans. Which includes plans for the drainage systems, access roads and road right of way.

4. Always look for HLURB License to SELL to make sure you have a legit investment. Always guard your investments. You are spending your hard earned money in the first place.

Please keep in mind that there are developers that sells lot only projects. And some have installment mode of payment. As long as you have all documents present most specially the HLURB License to SELL Number, your investment is pretty much in good shape.

Ikaw ba ay nakabili na ng lupa na naka-Mother Title pa? Yung pagkatapos mo magbayad, nalaman mo na nasa pangalan pa pala ng magulang/ lolo at lola/ ninuno ng seller ang titulo ng lupa?

Wag mag-alala. Maaari mo pa din mapalipat sa pangalan mo ang lupa na iyong binili.

Eto ang ilan sa mga proseso na maaari mo gawin upang mapalipat ang titulo sa pangalan mo.

1. Siguraduhin na may contact ka pa sa seller.

Para sa sitwasyon kung saan naka-mother title pa ang biniling lupa, kailangan may contact ka pa din sa seller. Marami kang kakailanganing dokumento at pirma na manggagaling sa seller. Ito ay kailangan kahit naibigay niya na sa iyo ang ownerโ€™s copy ng titulo at mas lalo na kailangan kung ikaw ay nakabayad na ng buo sa kanya.

2. Itanong ang relasyon ng seller sa nakapangalan sa titulo.

Kaano-ano ba ni seller ang nakapangalan sa titulo?
Ito ba ay kanyang mga magulang, lolo/lola, tito/tita, o kapatid?
Ito ba ay ang binilan ni seller o ninuno ng binilan ni seller?

Bakit ito mahalaga?

Ito ay mahalaga upang malaman mo kung ilang transfer ng pangalan ang kailangan mong gawin bago mailipat sa pangalan mo ang titulo. Dito mo rin malalaman kung ilang estate tax ang babayaran mo.

3. Magpagawa ng Extra-judicial Settlement of Estate.

Kung ang isang lupa ay naka-mother title pa, karaniwan, ang lupa na iyong nabili ay nakapangalan pa sa magulang, lola/lolo, o ninuno ng seller. Sa ganitong kaso, kakailanganin mo ang Extra-Judicial Settlement of Estate (EJS).

Ito ay dokumento na nagsasaad ng listahan ng lahat ng pag-aari ng magulang (o lolo/lola) na namayapa na. Ito ay nagsasaad ng pagkakahati ng mga ari-arian ng mga magulang ayon sa pagkakasundo ng mga anak o tagapag-mana. Kailangan na ang lupa ng iyong binili ay mapupunta sa parte ng seller.

Kung ang lupa ay nasa pangalan pa ng lolo/lola ng seller, dalawang (2) extrajudicial settlement ang gagawin. Ibig sabihin, dalawang salin ng pangalan ang kailangan bago ito mapalipat sa pangalan mo.

4. Makipag-usap sa seller tungkol sa pagbabayad ng estate tax.

Karaniwan, ang estate tax ay binabayaran ng mga tagapagmana upang mailipat sa pangalan nila ang titulo ng lupa na pag-aari ng kanilang magulang.

Dahil nabili mo na ang lupa na kanilang minana, maaaring ikaw o ang seller ang magbayad ng estate tax. Makipag-usap sa seller. Kung magkakasundo, maaaring ang seller ang sumagot sa estate tax. Maaari ding tawaran ang selling price ng lupa dahil sa karagdagang tax na babayaran.

5. Iproseso sa BIR at Register of Deeds ang pagpapalipat ng pangalan ng titulo

Matapos magawa ang Extrajudicial Settlement of Estate, ipasa ito kasama ng Deed of Sale at iba pang mga requirements sa BIR na nakakasakop sa lupa na iyong binili. Dito ay babayaran na din ang estate tax, capital gains tax at documentary stamp tax. Matapos ito, magbibigay ang BIR ng Certificate Authorizing Registration (CAR).

Ipapasa ang CAR sa Register of Deeds na nakakasakop sa lupa na iyong binili. Matapos ito iproseso, maaari mo na makuha ang titulo na nasa pangalan mo.
