Lessor's Right to Eject Without Court Action

A Lease Contract says that, if the Lessee fails to pay his monthly rent, the Lessor may reposses the property without going to court. In other words, the Lessor can evict the Lessee on his own, without court order. IS THE PROVISION VALID?

YES, the provision is valid. According to the Supreme Court in the case of CJH Development Corp. v. Aniceto, G.R. Nos. 224006 & 224472, [July 6, 2020], the provision is in the nature of a "resolutory condition", or a condition which, when it happens, effectively terminates a person's rights under a contract.

What happens here is that, as soon as the Lessor takes possession over the leased premises, the Lease Contract is deemed terminated. At that very moment, the Lessee loses all of his rights under the Lease Contract, including his right to remain in the premises.

In the case cited above, the Supreme Court reiterated that the contracting parties are free to stipulate on their terms and conditions, as long as the same are not contrary to law, morals or public policy. And this provision, according to the Supreme Court, is not illegal.

What does this ruling mean for lessors? That if you add this provision to your Contracts of Lease, you can padlock the leased premises, or repossess the same, without necessarily going to court. NOTE HOWEVER, the you will need a lawyer to properly incorporate this provision into your contract.
