The Subdivision and Housing Developers Association (SHDA) expresses its support for the implementation of Department of Justice (DOJ) Legal Opinion No. 16, Series of 2026, which concluded that the five-hectare retention limit under the Comprehensive Agrarian Reform Program (CARP) ceased to be effective following the statutory cutoff on June 30, 2014 (also known as the โCARPER Deadlineโ) and, as such, no longer provides a legal basis for requiring a Land Transfer Clearance (LTC) from the Department of Agrarian Reform (DAR) for uncovered private for agricultural land transactions without an existing Notice of Coverage (NOC).
At the same time, SHDA recognizes the importance of clear and uniform implementation to ensure that the DOJ Opinion is applied consistently by all concerned government offices. Accordingly, SHDA encourages the DAR, Land Registration Authority (LRA), Registers of Deeds (RODs), and other concerned agencies to promulgate joint administrative guidelines to establish clear, uniform, and coordinated procedures, documentary requirements, and inter-agency coordination necessary for the effective implementation of DOJ Opinion No. 16, Series of 2026.
SHDA looks forward to continued dialogue and coordination with the concerned government agencies in advancing a clearer, more efficient, and more predictable land administration framework that supports responsible real estate development and contributes to addressing the countryโs substantial housing needs.
