NOTICE TO ALL SELLERS AND PROPERTY OWNERS:
You are NOT Obligated to Pay Commissions to Unregistered and Unlicensed Real Estate Brokers, and/or to Unaccredited Real Estate Salespersons/Agents!
It is clearly stated on the Republic Act 9646 or The Real Estate Service Act those persons who are entitled to the commission which defined the following:
1. Article 1, Section 3(g)(4) Real estate broker - a duly registered and licensed natural person who, for a professional fee, commission or other valuable consideration, acts as an agent of a party in a real estate transaction to offer, advertise, solicit, list, promote, mediate, negotiate or effect the meeting of the minds on the sale, purchase, exchange, mortgage, lease or joint venture, or other similar transactions on real estate or any interest therein, and;
2. Article 1, Section 3(g)(5) Real estate salesperson - a duly accredited natural person who performs service for, and in behalf of. a real estate broker who is registered and licensed by the Professional Regulatory Board of Real Estate Service for or in expectation of a share in the commission, professional fee, compensation or other valuable consideration.
This is in relation to Article 4, Sections 27, 28 and 29 of the same law.
This is also in consonance with the Legal Maxim "Expressio Unius Est Exclusio Alterius." A Latin term literally meaning "the expression of one thing is the exclusion of the other". This is a common law principle for construing legislation which holds that a syntactical presumption may be made that an express reference to one matter excludes other matters.
Therefore, Sellers and Property Owners are liable only to Registered and Licensed Real Estate Brokers and to its Accredited Salespersons to the exclusion of others in all transactions pertaining to real estate.
Take care of your money. Deal only with Registered and Licensed Real Estate Brokers or Accredited Real Estate Salespersons.
