🔖Transfer Tax (0.5% but not over 1% of the selling price or zonal value whichever is higher depending on LGU where the property is located.

🔖Capital Gains Tax (6% of the total selling price)

🔖Registration Fee (depends on the amount of the property in the Deed of Sale)

🔖Notarial Fee (depends on the amount of the property in the Deed of Sale)

🔖Processing Fee (fee of the broker/agent who will transfer the title, depends on the agreement of the agent/broker and client)

How to Transfer a Land Title?

For many, the joys of acquiring a new property can easily be spoiled by the hassles of title transfer.
What does one do when the title of the property newly acquired is still under the previous owner’s name?
How to transfer a land title in the Philippines?
So, basically there are five steps:
1.) Gather all requirements (documents)
You have to secure all the documents from the Register of Deeds, Municipal or Provincial Assessor Office, and BIR (Bureau of Internal Revenue). What are these documents?
*Certified copy of Title
*Certified copy of Tax Declaration
2.) Assess and Pay Taxes
After gathering all the requirements, you have to secure the computation of the following taxes:
Capital Gain Taxes (from the BIR)
Documentary Stamp Taxes (from the BIR)
Transfer Tax (from the Municipal or Provincial Assessor’s Office)
After you get the computation of the taxes, you have to pay it through the banks for Capital Gain Tax and Documentary Tax.
For the Transfer Tax, you have to pay it to the Municipal or Provincial Assessor.
3.) Process and Get the BIR Clearance
After payment of taxes, you have to go back to the BIR. You have to submit the documents (requirements) and file for the issuance of Certificate Authorizing Registration (CAR).
4.) Process the Transfer of Title
After you get the CAR from the BIR, you need to file or submit this to the Register of Deeds. You need to get the assessment of the registration fees. After that, you need to pay it. And then you have to wait until the transfer of title is processed.
5.) Transfer of Tax Declaration
So after you get the title, you have to go back to the Municipal or Provincial Assessor to file for the application of the transfer of Tax Declaration.
The whole process normally takes around two to three months to complete. As you can see, these tasks are bit complicated. It’s very tedious and time consuming.

Beware of the word “CLEAN TITLE” You can only call it clean title IF: ⭕ Owners that appears in the title of the property...

Beware of the word “CLEAN TITLE”
You can only call it clean title IF:

⭕ Owners that appears in the title of the property are still ALIVE & CAN SIGN documents
⭕ NO disputes attached in the title AND “certified true copy” of the title.

Please take note of the word “AND” because not all disputes are printed in the original title itself. Thus, it is very important to request for the latest certified true copy of the title.
⭕ All real estate taxes are paid on time. Always request for latest real estate tax clearance.
⭕ If the owners are married (on or after 1987) the property is considered conjugal even if only one property owner is in the title. Both should sign sale documents. Should the property owner dies, heirs should file and pay for the estate tax of all the properties.
⭕ If the property estate taxes are not yet paid, the property cannot be called “CLEAN”.
⭕ Magkaiba po ang real estate tax na binabayaran ninyo annually at ang estate tax (BIR FORM 1801). You only pay estate tax if the owner in the title is already dead. Penalties (like big penalties) apply for late filing. ctto

THINGS TO KNOW WHEN BUYING A HOUSE!💯🏠💡

✔ 💰 Budget - how much can you afford monthly? Just how much you can start looking there.

✔ 🛣️ Location - you still consider your budget. If it's cheap, it's definitely far from Downtown. 5 million up price downtown.

✔ 💵 Required Monthly Salary - check how much your salary is because it will only base how much monthly you can get (can be combined salary)

✔ 🚻 Marital Status - always remember the legalities when you are married on paper even if you are separated from the eyes of the law, all your owns are still conjugal property.

🤔Common Questions:

1. Where is it?Is there any cheap?
✔ It depends on what you want, as long as you remember, as long as it's cheap, it's really far from Downtown.

2. May Rent To Own po ba kayo?
✔ There is really no rent to own. You will also release money from the Equity or Downpayment and the remaining can be loaned to Bank / Pag-ibig and you will just monitor the Bank / Pag-ibig that's why it's like rent to own the outside.

3. Do you have a transfer right away?
✔ if you can pay cash you can transfer immediately.
✔ If installment, you'll wait for the downpayment to pay, it's just ugly to be processed in the Bank / Pag-ibig that is 3-6 months. (you can pay the Downpayment in cash to be processed immediately in Bank / Pag-ibig)

4. When can I transfer?
✔ if your loan has been released by Bank or Pag-ibig .

5. What is Pre-selling?
✔ This means your house will be built, it's 18-24 months of construction for affordable or low cost housing. This is beautiful, the price of the house is cheap because there is no development yet. You can also pay the installments for Downpayment or Equity.

6. What is Equity?
✔ this is the same as the Downpayment and you are required to pay before you can be loaned to love.

📌Initial Requirements:

1) 2 Valid ID (SSS, Company, TIN, Passport, PRC, etc.)
-One month latest payslip

2) Within 30days ready the requirements then after that the downpayment will start

3) Submit the remaining requirements within 30days from reservation

4) After downpayment wait for Bank/PAG-IBIG processing 3-6mos before the start of Monthly Amortization.
