HOW TO PROCESS A DEED OF DONATION
(Real Property – Philippines)

Planning to donate land or a house to your child or relative?
Here’s the proper legal process:

STEP 1: Execute a Notarized Deed of Donation immediately upon decision
• Must be signed by Donor and Donee
• If married, spouse consent is usually required
• Attach valid IDs + TIN

STEP 2: File and Pay Donor’s Tax with BIR within 30 days from date of donation

Donor’s Tax is generally 6% of the property’s value
(Based on zonal value or fair market value — whichever is higher)

• Submit title, tax dec, tax clearance, IDs, etc.

Processing time for BIR eCAR: Usually 2–6 weeks (depending on RDO)

Late filing = penalties + interest.

STEP 3: Pay Local Transfer Tax usually within 60 days

• Pay at City/Municipal Treasurer’s Office
• Rate depends on LGU (around 0.5%–0.75%)

STEP 4: Transfer Title at Registry of Deeds: 2–4 weeks processing

Submit:
• BIR eCAR
• Deed of Donation
• Transfer Tax receipt
• Original title

Old title will be cancelled. New TCT/CCT will be issued under Donee’s name.

STEP 5: Update Tax Declaration: 2–4 weeks at Assessor’s Office

• Submit new title
• Secure new tax declaration under donee’s name

TOTAL ESTIMATED TIMELINE: Around 1–3 months (if documents are complete)

IMPORTANT REMINDERS ⚠️

✔️ Donation is NOT automatically tax-free
✔️ Title will NOT change without BIR clearance
✔️ Improper donation can create family disputes later
