Marami ang nag-aakala na kapag nakapirma na ng dokumento at nakatira na sa bahay, sa kanila na ang property. Maling akala po ito.

​Sa Pilipinas, may dalawang dokumentong dapat mong malaman para hindi ka magulat sa huli. Alin ba ang pinirmahan mo?

​Contract to Sell (CTS)

​Ang ibig sabihin nito: "Pangako na ibebenta ko sa'yo KAPAG nabayaran mo nang buo."

​Ito ay isang conditional agreement. Karaniwang ginagamit ito ng mga developers kapag installment ang bayad.

​Ownership: Hindi pa sa’yo ang property. Ang seller pa rin ang legal owner hangga't hindi tapos ang bayad.

​Posisyon: Maaaring nakatira ka na doon, pero ang hawak mo lang ay "right to buy," hindi pa titulo.

​Risk: Kapag nag-default ka sa bayad, mas madali para sa seller na bawiin ang transaksyon dahil sa kanila pa rin ang ownership.

​ Deed of Absolute Sale (DOAS)

​Ang ibig sabihin nito: "Bayad na, lipat na ang ownership. Tapos ang usapan."

​Ito ang final document na pinipirmahan at nino-notaryo kapag bayad na ang kabuuan ng property.

​Ownership: Ikaw na ang legal na may-ari.

​Taxes: Ito ang trigger para bayaran ang Capital Gains Tax (CGT) at Documentary Stamp Tax (DST).

​Transfer: Ito ang dadalhin mo sa Registry of Deeds para mailipat ang titulo sa pangalan mo.

​ THE REALTY CHECK:

​Contract to Sell = Pangako (Promise).

​Deed of Absolute Sale = Pag-aari (Ownership).

​Huwag hayaang lumipas ang maraming taon na CTS lang ang hawak mo kahit tapos ka na magbayad. Pagka-full payment, i-demand agad ang DOAS at simulan ang title transfer. Huwag hayaang nakatengga ang dokumento mo!

​Iwasan ang sakit ng ulo at protektahan ang pinaghirapan.

Mga ka-real estate—lalo na sa mga first-time buyers—ingat tayo. Hindi porket mura at “on process” ang lupa, good deal na agad.

Madalas na tanong:
“Okay lang ba bumili ng agricultural land na ipapa-convert pa lang to residential?”

Diretsong sagot: Delikado kung hindi pa approved.

ETO ANG DAPAT MONG ALAMIN:

1. Title Check muna!
Siguraduhin may malinis na titulo at walang problema.
Mag-verify sa Land Registration Authority (LRA) para sure.

2. Agricultural pa ba?
Kung oo—hindi ka pa pwedeng magpatayo ng bahay.
Kailangan muna ng conversion through:
✔ Department of Agrarian Reform (DAR)
✔ Department of Agriculture (DA)
✔ LGU zoning approval

Kapag “on process” pa lang — WALA pang kasiguraduhan

3. Hinahati ang lupa? (Subdivision)
Dapat may:

At habang may mga investors na nagpapalaki ng assets nila, ang karamihan—naka-stuck pa rin sa regular income at araw-araw na pagod sa traffic, pamasahe, at oras na nasasayang.

Yung oras at gastos mo sa biyahe araw-araw?
Pwedeng ‘yan na ang nagbabayad ng amortization ng sarili mong property—kung alam mo lang paano.
