ENGLISH VERSIONπŸ“Œ

"If I get married, does the property I bought while I was single automatically become conjugal property?" πŸ€”

This is one of the most common questions asked by property buyers.

πŸ“Œ Scenario:

Ana bought a condo while she was still single and signed the Contract to Sell under her name.

A few months later, she got married. They don't have a prenuptial agreement, and the remaining balance will be financed through a bank loan.

❓So, does the property automatically become conjugal?

πŸ’‘ The answer is: Not automatically.

If the property was purchased and the rights to acquire it were established before the marriage, it may remain the buyer's exclusive property in many situations.

However, if the loan payments or amortizations after the marriage are paid using the couple's shared income, there may be legal implications depending on the specific facts of the case.

⚠️ That's why it's important to understand your legal rights before buying or investing in real estate. Being informed today can help you avoid costly problems in the future.

πŸ“© Have questions about property ownership, bank financing, reservations, or real estate investments?

Feel free to send me a message. I'll be happy to guide you every step of the way!

The answer is: Hindi automatic.

πŸ“š Knowledge is protection.

🏒 What if the developer doesn't deliver what was promised?
Let's say you purchased a pre-selling condo because the developer promised a modern community with complete amenities, quality finishes, and an expected turnover date of December 2026.

You diligently paid your monthly installments and fulfilled all your obligations as a buyer.

However, before the scheduled turnover, the developer announced that the project would be delayed and that the new turnover date would be December 2028.

As a buyer, you may wonder:
"I've been paying on time. Why is the project delayed?"
This is where PD 957 comes in.

PD 957 was created to protect property buyers when developers fail to fulfill their commitments, including significant delays in project completion or turnover.

πŸ’‘ In simple terms:

βœ… If the buyer fails to continue payments, the situation may fall under the Maceda Law.
βœ… If the developer fails to deliver the project as promised, the situation may fall under PD 957.

When investing in real estate, you're not only buying a propertyβ€”you're also buying the commitments made by the developer. That's why it's important to know your rights and understand the laws that protect your investment.

Remember: Buyer defaults = Maceda Law
Developer defaults = PD 957

πŸ“Œ PD 957 (Subdivision & Condominium Buyers' Protective Decree)

🏒 Before buying a condo or subdivision lot, know your rights!

The PD 957 was created to protect buyers from unfair practices and ensure developers deliver projects as promised.

This law helps safeguard your investment by holding developers accountable for project completion, amenities, and representations made during the selling process.

πŸ’‘ A wise property buyer doesn't just look at the locationβ€”he also understands the laws that protect his investment.

πŸ“Œ MACEDA LAW (RA 6552) – Simple Example

🏑 What if you can no longer continue paying for your condo?

Let's say you bought a condo and have been paying for it for 3 years. Unfortunately, due to financial challenges, you decide that you can no longer continue the monthly payments.
Many buyers think that once they stop paying, all their money is automatically forfeited.

Not always.

Under the Maceda Law, if you've been paying installments for at least 2 YEARS, you may be entitled to a cash surrender value (refund).

Example:
βœ… Total payments made: β‚±300,000
βœ… Length of payment: 3 years
Under the law, the minimum refund is 50% of the total payments made.
β‚±300,000 Γ— 50% = β‚±150,000

πŸ’° In this example, the buyer may be entitled to receive β‚±150,000 as a refund, subject to the requirements and procedures provided by law.

⚠️ Take note:
The actual amount may vary depending on the specific circumstances and payment history.

The refund is not automatic. Proper notice and legal procedures must be followed.

The Maceda Law generally applies to installment buyers of residential properties.

πŸ’‘ The lesson? If life happens and you can no longer continue your payments, don't assume you've lost everything. Know your rights first.

πŸ“Œ MACEDA LAW (RA 6552)

🏑 Did you know?

If you're buying a property through installment payments, you're protected by the Maceda Law.

This law helps protect buyers who may encounter financial difficulties during the payment period. Depending on your payment history, you may be entitled to a grace period and, in some cases, a refund of a portion of your payments.

πŸ’‘ Property ownership is a big commitment, and knowing your rights is just as important as choosing the right investment.
