Is it true that your condominium's lifespan is set at 50 years?
One of the most common myths surrounding buying condos is that every condominium in the Philippines only has a lifespan of 50 years. After that, the building will be demolished, putting your investment to waste.
Letโ€™s take a look at RA 4726:
1๏ธโƒฃWhen you buy a condominium unit, you become part of a corporation.
A condominium corporation owns the land where your condominium is built. As a unit homeowner, you can think of yourself as a shareholder of that corporation. You can vote on issues like repainting common areas, changing the swimming pool tiles, or upgrading the facilities in the in-house gym.
Similarly, you can also vote on issues surrounding the fate of your condominium after 50 years.
2๏ธโƒฃ A corporationโ€™s lifespan is 50 years, but it can be renewed.
YOUR CONDOMINIUM DOES NOT HAVE A LIFE SPAN, but the corporation managing it has one. However, the corporation can still be renewed for another 50 years, so your condominium ownership does not necessarily end at that point.
3๏ธโƒฃ Three factors need to be fulfilled to declare a condominium uninhabitable.
โœ… First, it should exist for at least 50 years.
โœ… Second, it should already be obsolete and uneconomical.
โœ… Third, the owners should be opposed to any repair or restoration that can be done in the condominium.
It means that even if the condominium is already 50 years old, it doesnโ€™t necessarily have to be obsolete and uneconomical.
THE GOOD NEWS is that majority of todayโ€™s condominium developers construct condos using high quality and durable materials so modern condos will likely still be in good shape even after 50 years.
So, if this 50-year fallacy is the only thing thatโ€™s holding you back from investing in a condominium unit, then reading this should ease your fears and apprehensions.

๐Ÿ“ŒA REMINDER to ALL HOUSING PROPERTY BUYERS INCLUDING Condominiums โ—โ—โ—

Once you paid the equity in full and the housing loan in the Bank or Pagibig has been approved, effective asap the unit must be turnover already. (If unit is RFO or has been completed).

When the housing loan (Loan Take out) has been approved either thru Bank or Pagibig, the unit has been paid by them. Normally condo units are under Contact to Sell Loan so that means, once your loan has been approved, the turn over should already take place.
Means the Developer will now ready all the necessary documents to complete the Loan process and then prepare the turnover.

That's why you're already paying with the Bank or Pagibig the housing loan installments because The Bank or Pagibig already paid your Developer or Property Seller. At dapat madaliin na nila ang pag complete ng final documents and turn over documents.

โŒIf Developer keeps on delaying the Turnover so long after the Bank or Pag Ibig housing loan approval at nagbabayad na kayo ng instalments sa Bank at Pag Ibig.....

โœ…Please go to Department of Human Settlements And Urban Development or formerly known as Housing and Land Regulatory Board (HLURB) or Human Settlements Adjudication Commission (HSAC) and file a legal complaints to the Developer.
Sila po ang mga Regulatory bodies na nag police at nagiimbestiga sa mga ganitong malpractices or delayed condominium turnover.

โœ…In summary, you can demand for full reimbursement once your property turnover is delayed whether it is a condo or a house and lot. You are protected by PD 957 and can file a complaint with DHSUD, or Dept of Human Settlement and Urban Development formerly known as HLURB.

My condo is under Pagibig. The turnover was supposed to be December 2021 after paying the equity in full and Pagibig approval was November 2021, dapat immediate turn over na. The condo developer said madelay daw kasi nagka COVID surge that time at lockdown.

So I waited. When lockdown was lifted, I followed up and the agent and Developer Loans Department knows I am a Banker and I know all this Housing Loan process and I know where to lodge complaints if they will delay more the turnover, they will be penalized.
By February 2022, I moved in already. ๐Ÿ˜Š

Sabihan mo you will or better you file a legal complaint in DHSUD or HLURB if they keep on delaying โ—
