DO YOU KNOW THE DIFFERENCE BETWEEN THE FORESHORE LAND AND THE EASEMENT ZONE?

A foreshore land is that string of land margining a body of water; that part of the seashore between the low-water line usually at seaward margin of a low tide terrace and the upper limit of the wave wash at high tide usually marked by a beach scarp or bermpart of the shore, which is alternately covered and uncovered by the ebb and flow of the tide.

Whereas, an easement or salvage zone is that strip of land from the edge of the foreshore land towards the inland which is measured at 3 meters for urban land, 20 meters for rural or agricultural land, and 40 meters for forest land.

Both are lands of the public domain hence beyond the commerce of man.

From where the foreshore ends, salvage or easement zone begins extending inland, its delienation determined according to the classification of the littoral area.

Within this easement or salvage zone, no person shall be allowed to stay longer than what is necessary for recreation, navigation, floatage, fishing or salvage. (Art. 51, P.D. 1067 or the Water Code of the Philippines).

Also within this easement zone, building or constructing structure of whatever kind is prohibited, unless one has an approved lease tenement with the national government.
